While I fully agree with you that he should go directly to jail (do not pass go; do not collect $200) while awaiting his sentence, he is out until sentencing, scheduled for 9/11/2006.

When a person is a flight risk, I think he should be imprisoned immediately. Considering Lay's wealth (stolen), why wouldn't he be better off fleeing to the Cayman Islands, or somewhere similar.

Yes, he surrendered his passport, but could he leave the U.S. on a private plane? Land at a small private airfield? Probably.
