A CRY FOR HELP FROM BATTLE-STATION NEVADA

I am still battling alone here in Nevada...can you assist in any way. I intend to go to court on Monday (11/22 (edit note: Kennedy assassination in '63)) to ask for a temporary restraining order to stop Nevada State Secretary of State from submitting their 'final' tally to the Nevada Supreme Court to be accepted.

Thereafter the results will be forwarded to the US Senate as Nevada's final tally. I have been begging Black Box Vote to help with money or lawyer power...the lawyer power came to late for me to contest the election and their money to file has not been forthcoming. Now the only legal option that I have is to stymie or at the least sully the process and outcome here in Nevada.

Briefly the Nevada Secretary of State has denied me access to all abstracts/voter statements other than the very cursory data which is on their website. I have been met with outright hostility from the Washoe County Registrar Dan Burke, who told me to "behave myself" when I asked him questions about the county process and final tallys. When I insisted upon explanations he threatened to have me thrown out of the office which means that I would have been arrested. His direct words were "shut up and get out or I'll have you thrown out" by police force.

Despite their best efforts to contain me I have obtained a copy of the Washoe County Abstract/Voter Statement and it is very obvious that Washoe and the State of Nevada are playing fast and loose with the vote tally. There are at least 2400 votes unaccounted for with no under vote indicated on the tally to adjust for missing numbers. There are a number of other mysterious disappearances of vote to include a total category of voters whose vote was not entered into the final tally. The list of wrongdoings is extraordinary here because there is no oversight at all. I'm it.

38. UPDATE from hedda_foil of Help America Recount 11/21, 7 pm
I sent this information on to Hedda this afternoon and she emailed me back at some length.

Hedda was in contact with Axelrod already last week and in fact, Help America Recount paid for a legal consult with one of the attorneys working with HAR on these recount issues.

Unfortunately, Nevada has some stiff requirements relative to what Axelrod wants to do, and the attorney suggested she take another specific tack since the possibility of prevailing in court under these circumstances with what she wants to do is about nil. Also unfortunately, Axelrod is not following the counsel provided to her through HAR, so hedda_foil suggests DUers not "waste their money" contributing to this effort. Well, I'll let her speak for herself on this:

We do want to try to do something in Nevada, but Axelrod would be a plaintiff from hell. She interprets the law the way she wants to interpret it and that's that, whatever the lawyers or anyone else says. Please tell DUers NOT to waste their money on her. If they want a real shot at recounts and they want to donate their money, HAR is the way to go, because if there's a real case that has a chance of being won there we'll do everything we can to make it happen, and meanwhile we'll be going into court to file contests in Florida quite soon ...where there could really be a possibility of changing the election and proving the disastrousness of both touch screen and op scan voting.

HAR has lawyers, have lined up some PR folks to help with the getting the message out to the media, also working with Common Cause and a number of other organizations and individuals.

Hedda went on to say that there IS another case they're looking at in NV and hope to be able to assist with.

2. Have you contacted Bev Harris about the voting irregularities in Nevada?
if not, contact her ASAP. If she can't assist you, maybe she has some suggestions as to how to fight for a recount in Nevada.

14. Obviously, you didn't read my post very carefully,
as I suggested Bev Harris as the first point of contact. I am as aware as anyone that Bev is extremely busy right now, but I'm also aware that she is the focal point of voting fraud/recount efforts and would have information that could help point the original poster in the right direction.

Contacting police, FBI, DA's and newspapers? If only they would respond, that would be a good idea. Why is it that Olbermann is the only reporter in the MSM who is covering voter fraud? It would be an exercise in futility to try to contact anyone else in the MSM right now. In any event, flying under the radar right now is the right thing to do. Sorry you don't agree.

Bev Harris as a contact point, but there is so much information flying around DU right now that I thought giving the name of one person that I KNEW to be knowledgeable about what the story is vis a vis voter fraud and those in the know to contact for help.

As for police stations getting calls from the general public, I don't know that they would even do anything or be so inclined as to do anything. The FBI and police are part of the problem, I fear. I posted a link (this is the first time, so I didn't do it right, but it is in the same forum (2004 Election results and discussion). Basically, the the post details Ohioans going the FBI and getting referred right back to the SOS of Ohio, Mr. Blackwell.

What I meant by "under the radar" is that more can be accomplished by working very quietly, gathering facts and building a case that offers incontrovertible proof of widespread voting fraud. If officials are alerted to a degree that the MSM starts to pay attention, we might have Florida 2000 all over again. I don't think we want that right now.

I hope that I have clarified my position.

are DUers hedda_foil and IdaBriggs. Hedda is co-founder of the National Ballot Integrity Project ( www.ballotintegrity.org / )and the new 527 set up specifically to help fund and do other work (e.g., PR/media work) on behalf of these recounts:

I know that a lot of the recounting and challenging focus is on Ohio, but I think something needs to be done in Nevada, New Mexico and Iowa as well. In my view all of our efforts need to be spread out to as many states as possible. What if the exit poll in Ohio was wrong and Bush won?
What I have learned in the last 4 years is that Rove is not stupid. It's like a chess game. You have to be able to anticipate your opponents move in advance.
I don't know the legal options but I think we need to go after the results in every state that seems to be suspicous.

NRS 293.407 Filing of written statement of contest with clerk of district court; verification.

1. A candidate at any election, or any registered voter of the appropriate political subdivision, may contest the election of any candidate, except for the office of United States Senator or Representative in Congress.

2. Except where the contest involves the general election for the office of Governor, Lieutenant Governor, Assemblyman, State Senator or justice of the Supreme Court, a candidate or voter who wishes to contest an election, including election to the office of presidential elector, must, within the time prescribed in NRS 293.413, file with the clerk of the district court a written statement of contest, setting forth:

(a) The name of the contestant and that he is a registered voter of the political subdivision in which the election to be contested or part of it was held;

(b) The name of the defendant;

(c) The office to which the defendant was declared elected;

(d) The particular grounds of contest and the section of Nevada Revised Statutes pursuant to which the statement is filed; and

(e) The date of the declaration of the result of the election and the body or board which canvassed the returns thereof.

3. The contestant shall verify the statement of contest in the manner provided for the verification of pleadings in civil actions.

4. All material regarding a contest filed by a contestant with the clerk of the district court must be filed in triplicate.

I just read that four private citizens got a recount to go forward in Puerto Rico--for two gubernatorial races. So I know it can be done.

The way I read the Nevada statute is that a registered voter can file a complaint to contest the election. It does not say that you need an attorney to do so.

CARSON CITY, Nev. (Nov. 18) - A businessman has filed a challenge to the Nov. 2 election, saying thousands of Nevadans may have been denied the right to vote.

The challenge filed Tuesday in Washoe County District Court alleges there were "massive irregularities and malfunctions in the registration process."

Six Republican electors are scheduled to meet following the state Supreme Court's Nov. 23 canvass of the election and officially give President Bush Nevada's five electoral votes.

The election challenge filed by Rick Newell Davis, of Minden, asks that anyone who was disenfranchised be allowed to vote before the results are declared final and official.

Davis, who just changed his registration from Democrat to Republican, said Wednesday the contest wasn't filed for partisan purposes.

"Whether you're a Democrat or a Republican doesn't matter," he said. "All the people should be concerned about election misconduct."

The alleged irregularities resulted from the activities by an organization financed by the Republican National Committee, according to Davis.

Some former workers for Voter Outreach of America, operated by Sproul and Associates of Phoenix, who registered voters in Nevada and other battleground states have alleged they were told to register only Republicans and to ignore pro-Kerry people. Some said that completed Democratic registration forms were thrown out or ripped up.

The head of the company, Nathan Sproul - a former Christian Coalition activist and one-time executive director of the Arizona GOP - has denied any wrongdoing.

Bush defeated John Kerry by 21,500 votes in Nevada, 418,690 to 397,190.

If the final count hasn't been certified yet, it would seem that the dealine to contest has not yet be realized either. How can you protest until the votes are certified? :shrug:

He is investigating Sproul, whose company is responsible for trashing possibly thousands of Democratic voter registrations. Perhaps you can present a case for not submitting the final tally until this matter is investigated more thoroughly. (IIRC, there were 14 states that Sproul's company may have tampered with the registration process.)

"Officials in Oregon have launched a criminal investigation after receiving numerous complaints that a Republican-affiliated group was destroying registration forms filed by Democratic voters statewide, Oregon Secretary of State Bill Bradbury told CBSNews.com.

Meanwhile, CBS affiliate KLAS-TV is reporting accusations of similar malfeasance in Nevada.

Both state's allegations are linked to a Phoenix political consulting firm called Sproul & Associates run by Nathan Sproul, former head of the Arizona Republican Party. Sproul & Associates has received nearly $500,000 from the Republican National Committee this election cycle, according to the Center for Responsive Politics.

Calls from CBSNews.com to Sproul were not returned.

Late Thursday afternoon, two Democratic senators, Patrick Leahy of Vermont and Ted Kennedy of Massachusetts, sent a letter to Attorney General John Ashcroft asking the Justice Department to "launch an immediate investigation into the activities of Mr. Sproul and his firm."

i've just spoken with shraby's husband (?) - she's off at the law library right now. i have brought this to laura flanders attention in the hopes that she will mention it on her show today that is focusing on vote fraud issues and i am also putting the information out to my kerrywon email list. this needs all the attention it can get!
