It sure is.

That's why Bush v. Gore would be a terrible use of SCOTUS opinion in Ohio.

The SCOTUS Bush v. Gore opinion basically says, Florida SC ruling to recount ballots violated the 14 amendment and stuck down the Florida SC decision because the statewide recount would not happen soon enough to certify the election before the EC count was certified.

In other words, Florida electoral college votes would not count thus violating all Floridians 14th amendment who cast their vote.

it seems to me that Kerry has been very active lately, and on issues that are important to us. In fact, it almost seems to me that he has had more positive mainstream media coverage than he did before the election.

Interesting timing... now that the inauguration is over, news has moved away from the election, and the White House is feverishly attempting to quiet the Guckert/Gannon story, Messrs Kerry and Edwards are busy in Ohio.

10. It was always going to come down to evidence.
That is how he worked as a prosecutor to prevent going to court and losing. If he didn't have a preponderance of the evidence he wouldn't have his office prosecute cases needlessly.

Whatever comes of this now will be for the good of the country, even though it may not work to Kerry's personal benefit.

This is also why they held on to some of the campaign funds.

36. This may all work out in the end. Now Shrub's cabinet nominees all lied
under oath. And if one card in this house of cards gets taken down by the courts, so go the rest. I really was quite disappointed with Kerry lately, but now I see perhaps he was proceeding cautiously all along. Though I promise not to get too hopeful yet...

Ironically (in a bit of serendipity), earlier today I put a new "Kerry/Edwards" bumper sticker on my car. (My old one got damaged in the car wash yesterday.)

as in "ever faithful."

He has a pattern of sticking with something, for years if he has to. He's still on the BCCI case after all these years, as the people who lost money in that bank take it to court, blasting the Bank of England for not doing more to help those people.

It may not be a fast-moving process, but I think we will see these little reports from time to time to let us know he's still on the case. Maybe something will eventually happen, maybe not.

I understand your caution, but I can't help but think that they pissed off the wrong fellow. It will be the end of them yet.

it will show people that he indeed does what he says he's going to do. For some people no matter what he does, it will never be enough. For those of us who have studied Kerry a little closer, it is just in keeping with who he is. I believe he is a patriot above all, a politican second, and while he won't be sitting in the oval office anytime soon, I think our democracy (or lack of it these days), would be more important to him. As a prosecutor he never lost a case. That gives me great hope...

Thanks for this article and info! Great to see it's still being pursued.

I'm wondering are there any other court cases that haven't been thrown out yet? I know bev harris has some cases pending in FL...

And what's the status of the Alliance For Democracy? I know they are getting screwed by a countersuit, but are we to believe they're done? I feel bad for Cliff and all of them, but I wonder if they're still planning to file another suit somewhere. I remember when they withdrew Moss V Bush they promised they were going to continue to collect evidence and file again somewhere else.

HOpefully at least one of these cases will bear fruit!

65. There is the Rois case pending in Ohio Federal as referenced in
the Court's order of 2/14 and I believe there is another one pending in Ohio Federal court. White may be the name of the plaintiff, but the easy to check is to use Pacer. As far as I know, Pacer only has access to federal dockets and not state filings.

http://pacer.uspci.uscourts.gov/

You have to register and if you view a docket or documents, you will be charged 8cents a page. They will bill you every 3 months or you can put it on a charge card.

If you want ohio cases, search under the party name of Blackwell.

39. I'm telling you, Bushco are NOT going to serve out their term.
About 4 major psychics have said so. One in particular, I remember, said that by 2006, Bush would have NO connection with Power.

I still contend it IS Kerry's destiny to be President (and NOT as late as 2008). How we'll ever get this through the Repug-controlled court system will be a major miracle in itself, but....forever the optimist...fingers crossed!

64. OK..I found some info, but not all.
Kerry is quoted saying what you have repeated "I'm glad to say I never lost a case in Middlesex" (his bio on his website), But I can't find the number you give 7000+.

He spent 3 years in Middlesex in the DA's office, 76 to 79.
52 weeks * 5 days * 3 years = 780 workdays in that office (approx)

Which would equate to (7265/780=9.31) winning 9.3 cases per day.

I would think it is likely that the 7265 is total cases in his lifetime, and the unbeaten part only applies to his 3 years in Middlesex DA's office, which is still quite amazing.

If you come up with other info, I'm still interested. 8)

This is from the Boston Globe:

Kerry said he isn't sure where his figures came from but recalled a concerted effort to clean up a mess. "We adjudicated a number of them, we had to dismiss a whole bunch for lack of evidence, lack of witnesses, people had moved or didn't want to testify," he said. "We went through every case." >>

And the quote you have about "I never lost a case in Middlesex" is as much as I can document on that, too, so far.

The overall point, as it applies to the original thread, is that Kerry was the type of lawyer to never go to trial without a solid case, and that would apply to the election, too. He would never have gotten up and just complained about it, without having solid proof in hand.

Thank you for your time, I hope it wasn't a bother.

The part about cleaning up a back log by adjudicating a 'whole bunch' makes the number of cases easier to swallow.
If he adjudicated 4000 cases, well that's 4000 cases without a loss.
I'm not saying there is anything wrong with that, ya gotta do what ya gotta do. That was a hell of a back log to clean up.

Your link describes exactly one case that Kerry took to trial as a prosecutor. Commonwealth v. Edgerly

At no point did that article say that Kerry tried or won over 7000 cases. It did say, though, that the entire caseload, including the backlog, in Middlesex County was (drumroll) 7,265 cases. That would include cases pending, plea bargains, dismissals, losses, and cases transferred to other courts.

Kerry boasted that he had cleared 11,000 cases, but that number was 3,735 greater than the entire caseload for the Middlesex County Prosecutor's Office during his time there (plus the cases that were backlogged when he left.) It was at that time that he earned the nickname, "Live Shot."

There has been WAY ample time for the crooks to compromise the programming of the previously compromised central tabulators and voting machines. And just think of all the paper ballots that have surely been "audited" by republican activist thugs.

I am VERY glad that the 2-Johns are in on this, but it seems to me the forensic evidence is getting away, or has already gotten away.

I'm also curious as to what's still happening in all of the other states that bush stole with his slimey army of thugs.

Well, I think these K/E legal actions are, a) looking forward to '06 and '08, not back to '04 (putting the BushCons on notice about the NEXT fraud they try to pull, and trying to get some rulings and evidence in place to stop them), and b) possibly also meant to undermine the phony "mandate" that the Bush Cartel claimed (as well as gain some Brownie points for the Dems with the grass roots, and maybe assist grass roots efforts at election reform).

Unfortunately, Congress constitutionally holds almost total power over who becomes president. If I read the Constitution right, they can even ignore who people voted for (if there is sufficient controversy about the states' electors) and choose someone who didn't even run. So, no court ruling--not even Sup. Ct.--can overturn Congress' decision on Jan. 6. (And Sup. Ct. should never have ruled as they did in '00. If their decision had gone the other way--FOR Gore, and upholding FLA law--Congress could have intervened and thrown it to Bush, when it got to Congress. That's why Sup. Ct. said B v G was not a precedent. They were on paper thin ice--a one time, unique ruling to install the Bush Cartel, which the Democrats in Congress very unfortunately decided not to challenge.)(They had the votes at that time.)

The Constitution does not make provision for BOTH a president and Congress itself having been chosen illegitimately. It could not have anticipated electronic voting--nor Roman Empire II, with so much power and money at issue (although the Founders tried their damnedest on the latter).

In all justice, Congress should never have accepted the Ohio electors. There were massive violations of the Voting Rights Act, and huge indications of fraud. And if someone could have done it, FLA and some other states should have been challenged on those grounds as well. Also, there was a quite early UC Berkeley study on electronic fraud in FLA, and the exit poll stuff came out and was being published within a few weeks of the election (Dr. Steven Freeman, Jonathan Simon and others). All of this SHOULD HAVE BEEN looked into.

But there was, is and never will be justice in this Congress. The BushCon majority was illegitimately obtained--by electronic and other fraud in '00, '02 and '04. They are lockstep Pod People for Bush. I listened carefully to them all during the Rice and Gonzales debates, and I did not hear a single independent thought from any Republican in the entire debate--what a sorry ass political party it has become!

This is what K/E is up against--and what they WERE up against on 11/3. Not a chance in hell that Congress would give them justice. They could have had a hundred "smoking guns" and it would have made no difference whatsoever (and, in fact, they had more than one at the time--Blackwell's actions, the "terrorist" lockdown, the touchscreens programmed to change votes to Bush). I think they and the DNC bear some blame for not screaming bloody murder over Wally O'Dell and HF Ahmanson gaining control of our election system--and for their support of the Iraq war--but that's a separate discussion. We're talking about what their legal actions might be aimed at NOW. Overturning the election is not possible, nor is impeachment possible with these illegitimately elected Pod People in charge.

It is perhaps petty of me in view of the huge corruption and the loss of democracy, but I would like to add to the list if possible:
Indicting and convicting Blackwell for his crimes in promoting and abetting the fraud and then interfering and blocking lawful investigations afterward.

Not only would this be a small triumph of justice over the corrupt and illegitimate neocon machine, it would also send a message to other would-be Blackwells who seek to climb the ladder to political favoritism by deliberately promoting corruption of the democratic process. If the blivet** cartel is the only boss that needs to be pleased, then there will be plenty of petty criminals like Blackwell to lick their boots and promote their crimes everywhere. Blackwell himself is busily planning on converting his contribution to the coup d'etat to a guaranteed election as Governor. This MUST be stopped. There MUST be accountability for his crimes. He belongs in prison and in disgrace, not in the state house.

How do you see the chances for this?

Since they have been taking the heat for his social security proposals back in their own districts while he dines on lobster and fine wines with his 80 limos in Europe, they saw the inauguration fiasco, (I particularly like how soldiers were invited to the exclusive balls and were not provided with anything to eat and had to stand for hours - this was George's thank you!), and now the Republican leaders have been jeered at back home. Right now it is becoming painfully clear to them that this administration is an albatross which they will carry in '06. Especially when many republicans are calling Bush's WH-the whore house.

Of course it's too late to remove him. One may think that, because it would be a huge story ("Bush not legitimately elected"), it would at least raise the awareness of the pathetically ignorant masses. But how would they find out?

After 2000 it was determined that, if all the votes had been counted in Florida, Gore would have been elected. And we know that black votes were disqualified there at a rate 10 times that of white votes. We know that over 6600 Palm Beach 'butterfly' ballots were marked for both Gore and Buchanan and therefore disqualified as overvotes. We know that thousands of uncounted Florida ballots had every candidate selected but Bush (vs. hundreds of anyone-but-Gore ballots). And we know that the official Bush victory margin in that state was under 600 votes.

It's impossible to avoid the conclusion that the 2000 presidential election did not reflect the will of the voters- no conspiracy theory required. Yet, among the mainstream media, where has this story been reported? The Palm Beach Post's articles

I haven't had time to read everything yet, so maybe this is a moot point, does anything address all the sleaze activities? I keep thinking about all those people that stood in line, the woman who went outside for fresh air and wasn't allowed back in. The list goes on and on, as everyone one here knows. How are all those issues being resolved? The red truck with the * sticker, piled high with tons of ballots in it still freaks me out. I want to see the scum exposed and prosecuted! Maybe this is the first step. I have always thought Kerry was investigating quietly and that he was just waiting until he had something concrete to be able to prove. If nothing else, hopefully this will prove to everyone that he is rightfully the MAN.

I think we are all aware of the difficulties of changing anything, but that does not mean we just roll over and pretend everything was clean and legal. If there is the slightest chance we can PROVE that * was not legitimately elected, that is enough to denigrate every single thing he tries to pull. I, for one, would like to see him take that last walk a la Nixon, probably not going to happen, but ANYTHING that will diminish him into oblivion will be welcomed.

Proving that election fraud took place would be a great thing. It would ensure that it wasn't able to be done again, and possibly the people who allowed it to happen would spend some time in jail, rather than be promoted. It gives me tremendous hope that the truth still may win in the end.

As for focusing on the future - that's exactly what they're doing. It would sure make me feel better about voting if I knew my vote would be counted. That IS the future.

113. I am so glad to see they are following up on the election probs
It adds to the truth that is coming out against the repubs and their lies to the American public. I called and left a message as well just to let the Senator and others know we are still watching and appreciating the fact that the fight goes on for the right to vote in our democracy.

119. I hope you're right.
I am still trying to make sense of Kerry's concession, but this is a good step in the right direction. I am sick of all the Kerry bashing that goes on here.
