Charges Filed Against 12-Year-Old Boy In Parents' Killing

OSAGE BEACH, Mo. -- A 12-year-old boy was arrested on suspicion of killing his parents Monday night, Miller County Sheriff's Department said.

Two first-degree murder charges have been filed against the boy in the shooting deaths of his mother, Rachael Duncan, and stepfather, Jason Duncan. The 26th Judicial Circuit's chief juvenile officer, Tammy Walden, told The Associated Press on Tuesday there will be a hearing later on whether the boy will be tried in adult or juvenile court.

Around 11:50 p.m. Monday, police were called to the Palace Lane Estates mobile home park in Kaiser, Mo. Police said the boy called his grandmother, who lives in Kaiser, and then 911 to report that he shot his mother and stepfather.

Neighbor Stephen Garner said the boy went to a friend's house earlier in the evening, begging to stay there because he said he was being abused.

These cases are tough for me. Children are so limited.

If he was being abused, and was unable to get assistance from those outside his home, wouldn't this be considered a sort of self defense. A child cannot even leave a location without parental consent. If the overwhelming power a parent has over a child is being abused then a child is left with very little recourse.

I do hope the boy is well protected now and that he receives fair treatment.
