An email I sent to the White House today
I don't know who reads these emails, but I sent it anyway. I plan on calling later today. I urge everyone to either call or write. We all still have a voice and if he hears from all of us maybe we can make a difference.

President Obama
I want to let you know that I have been a supporter of you since you announced your candidacy for president on that cold day in Springfield, you were my state senator and I was so proud that we had a candidate representing the state of Illinois. I thought you were a great state Senator and you had my full support. At that time I was unemployed and even though I didn't have a lot of money I donated 40 dollars to your campaign, I believed in you and the change you were going to bring to Washington. When you won the Presidency I was watching the television and crying, you moved me with your speech and I knew that the last 8 years was soon going to be a nightmare that would be over. I knew that the change you talked about so eloquently in the campaign would become a reality. So I write this today with a heavy heart, although you have done some amazing things, SCHIPP, the plan to revitalize the economy and many other great things I am disappointed. I heard you speak last week on national security and you talked about something called "indefinite detention". I had a hard time believing what I was hearing. You told the American people that you would hold people who had committed no crime indefinitely because of the potential to commit "future crimes". I must ask you Mr. President, how is this constitutional? How can we as Americans hold people in prison for something they didn't do? You say it is necessary for National Security, but this is the same arguement that President Bush used for suspending Habeus Corpus, for Military Tribunals and for torture. I feel very disheartened by some of the things you are doing Mr. President. I supported you whole heartedly, I got many of my friends to vote for you, even Republicans, and I am frankly dumb-founded at some of your policy decisions. Mr President, why are you so adamant when you tell the American people that we should be "looking forward" when it comes to torture? Why are you against prosecutions for war crimes? Why are you against even something like a "truth commission". Many people say that if you do this then you are complicant in the said war crime. I don't want to say that sir, because I still have the hope that you are the right person for the job. I want to believe in "hope", I want to believe that you are still the man I voted for. Many people want the ones who authorized torture, who carried out the torture to be accountable for the crimes they committed. I know I don't have to tell you that we prosecuted the Japanese in WWII for waterboarding. I commend you that you have ordered that these inhuman practices will no longer be carried out on your watch. I commend you that Gitmo will be closed, a reminder and a black stain on our country. Please President Obama do the right thing, I still believe even though I am very disappointed. Please prove me wrong. I am still rooting for you.

1. It's great that you took the time to write him such
a well thought out letter. I disagree with you though. If we don't get the major things done like healthcare, etc. because Obama took on the justice dept's job, then Bush&Co will have won AGAIN.

2. I respect your opinion
and even understand it. It could be politically dire for Obama to take a stand on these issues but I feel like the rule of law is that important and I trust that Obama can do more than one thing at a time.

As your characterization of what he said doesn't exactly jive with what he actually said. ;)

Now, finally, there remains the question of detainees at Guantanamo who cannot be prosecuted yet who pose a clear danger to the American people. And I have to be honest here -- this is the toughest single issue that we will face. We're going to exhaust every avenue that we have to prosecute those at Guantanamo who pose a danger to our country. But even when this process is complete, there may be a number of people who cannot be prosecuted for past crimes, in some cases because evidence may be tainted, but who nonetheless pose a threat to the security of the United States. Examples of that threat include people who've received extensive explosives training at al Qaeda training camps, or commanded Taliban troops in battle, or expressed their allegiance to Osama bin Laden, or otherwise made it clear that they want to kill Americans. These are people who, in effect, remain at war with the United States.


(notice all of the past tense verbs used there)

Let me repeat: I am not going to release individuals who endanger the American people. Al Qaeda terrorists and their affiliates are at war with the United States, and those that we capture -- like other prisoners of war -- must be prevented from attacking us again. Having said that, we must recognize that these detention policies cannot be unbounded. They can't be based simply on what I or the executive branch decide alone. That's why my administration has begun to reshape the standards that apply to ensure that they are in line with the rule of law.


In attempting to hold these hypothetical prisoners, he will, working with all branches of government attempt to answer HOW it can be done Constitutionally.


We must have clear, defensible, and lawful standards for those who fall into this category. We must have fair procedures so that we don't make mistakes. We must have a thorough process of periodic review, so that any prolonged detention is carefully evaluated and justified.

I know that creating such a system poses unique challenges. And other countries have grappled with this question; now, so must we. But I want to be very clear that our goal is to construct a legitimate legal framework for the remaining Guantanamo detainees that cannot be transferred. Our goal is not to avoid a legitimate legal framework. In our constitutional system, prolonged detention should not be the decision of any one man. If and when we determine that the United States must hold individuals to keep them from carrying out an act of war, we will do so within a system that involves judicial and congressional oversight. And so, going forward, my administration will work with Congress to develop an appropriate legal regime so that our efforts are consistent with our values and our Constitution.
