Judge Allows Challenge to Washington State Governor's Race to Go Forward

WENATCHEE, Wash. (AP) - A judge allowed a court challenge to Democratic Gov. Christine Gregoire's excruciatingly close election to go forward Friday, rejecting arguments that the dispute can only be resolved by the Legislature.
The ruling by Superior Court John E. Bridges came at a hearing on a Republican attempt to overturn Gregoire's election.

Gregoire was sworn in last month after being declared the winner by a mere 129 votes out of 2.9 million cast.

But Republican candidate Dino Rossi and the state GOP say the contest was tainted by so many errors and illegal votes - including ballots cast by hundreds of felons - that the courts should throw out the results and order a new election.

The Republicans refused to give up EVEN THOUGH GREGOIRE WAS SWORN IN!!!

Skinner in ATA wondered why people were down on Lieberman. He gave up before the court cases even went through and urged Gore to concede! Without spines, Dems will ALWAYS LOSE!

1. A bit premature Walt. This was NOT unexpected.
Chelan county is heavily republican.

That's why the pukes chose it. Likely this will go all the way to the state supreme court and they will probably throw it out.

2. The point is, the Republicans continue to fight even though they lost and
the winner took office.

They refused to let it rest, unlike the Democrats. That capitulation by the Dems lead to a legitimizing of an illigetimate presidency, thus allowing for a "re-election".

3. That's not the point I was objecting to...it was your fatalism.
In thinking that just because a repuke judge in Chelan county is letting the case go forward that the repukes will win.

Negativity doesn't help us anymore than capitulation.

...there never would have been a hand count to begin with.

Give credit where credit is due here. We haven't stopped fighting anymore than the pukes have in Washington State. The simple fact is that we don't have the RIGHT to stop them from a court challenge in this.

We stopped them in the recount. We stopped them in the legislature. And likely we win this as well.

Don't make things worse by thinking negatively.

23. No that IS the point- we should have sued in Fla. 2000 and 2004.
Not to mention Ohio. The lonely voice of Barbara Boxer is not exactly comparable to fighting tooth and nail, like the repuiblicans do.

your post is not complaining about how Dems are reacting in Washington today, but pointing out that if we Gore had responded in 2004 the way that Rossi is responding today, he might have changed the outcome of that race?

15. I have read the briefs in the case
The briefs on this case are on the Sec. of State website. I think that the Democrats should eventually prevail on this case. The judge is a republican and was not going to throw the case out. The real issue will be if the Democrats can do an interlocutary appeal on this issue or do they have to wait until the case is tried.

The fact that the judge did not throw the case out at this stage is not surprising. This case is going to be ultimately decided by the Washingon Supreme court. This way the judge can build a record and have all of the issues before the court when it is appealed.

This case is not going to be resolved anytime soon. Christine's first term may be mostly up before this case gets through the courts.

17. Is it possible if there is a revote that it could be on paper ballots?
If I were Gregoire and it looked like they were going to get a revote, I'd say fine we can revote but it has to be on paper ballots hand counted. She'd win by an even bigger margin, and put an end to this crap.
