Miami-Dade man killed while taking rifle from car trunk
A West Miami-Dade man was fatally shot when he tried to help another person get a rifle out of a car trunk, Miami-Dade police said.

The rifle belonged to Felix Santana, 21, police said. Santana was charged with manslaughter.

An arrest affidavit, released Tuesday, detailed what police believe happened.

Santana, police said, got the .22-caliber rifle from a cousin about a week ago. He used it for target shooting. He also left it in his car trunk, loaded and without a trigger guard, the affidavit said.

was it Wisconsin? One would hope it does not spread... Such a waste

2. Well let's see ...

Loaded ... check
Safety off ... check
Cocked ... check

Let's just take the trigger guard off for good measure.

You could almost start the countdown timer waiting for something tragic to happen on this one.

3. Well
It must have been one heavy-ass .22 All of the one's I've owned only took one person to get out of a car.

I do believe there is more to this story.

Sad that instead of approaching people in here in an open manner to address the issues about firearms and gun control you are concerned about from a standpoint of common ground, you choose instead to go with the insulting route of snark and sarcasm which tends to instantly shut down rational discussion on a topic.

ever seen a post for gun control from me, one denying gun ownership? What you have seen is posts about the misuse of firearms. I don't stick my head in the sand when it comes to firearms, I know we can do better. Maybe it's something the gun forum members should consider. As long as you let the NRA drag you around you'll continue to alienate Democratic gun owners. The ball has always been in your court for change. Keep paying the dues, keep loosing Democrats, it's that simple.

26. Sounds like a poor execution of very good idea
I don't think anyone has their head in the sand. It is a matter of what is said is different than what is being heard. In your case, your method is similar to what antis do to to dance on a grave. Can't come up with a decent analogy.
As for the NRA goes, it became what it is today because of infighting between the traditional sportsman/environmentalists and the hardliners in the 1970s. Guess who won. With that in mind, I lean towards Euromutt's stance of taking on the crazy people from within.

Alienate Democratic gun owners from what, each other? I don't get where you are coming from exactly.

27. Try this
you know that I posted a question in the gun forum about traveling through Idaho and Montana correct? Go back and re-read the thread, how many people were helpful and how many were rude and hateful? When you get the answer you may understand just how helpful the gun forum really is. An honest question met with attitude and hatred. I think it's shameful and DU should address the forum regulars about it. It shows the forum is not very helpful to outsiders.

34. I have noticed outsiders showing up with questions or
points and being answered very politely by the same regulars. There are cues people pick up on. All of the cues I picked up were as if you were a anti like the usual suspects. I guess the same with others. I still say it is a poor execution of a good idea.

25. And some of your best friends are "toters," right?
I own quite a few firearms and have a CWP in the state of Washington.

Why do you bother, when you believe concealed carry to be a "fallacy"?

http://www.democraticunderground.com/discuss/duboard.php?az=view_all&address=118x419515

In you own words, "CWP, fail once again." So why have a CWP? Do you carry? How often? Would you trust yourself to carry in a bar, or do you think you'd get trashed and start killing people?

http://www.democraticunderground.com/discuss/duboard.php?az=view_all&address=118x420740

"Guns in bars doing what they are made to do." Isn't that what you believe?

28. first
guns in bars is a bad idea, I get an opinion outside the NRA talking points correct? I don't carry a weapon, I use my permit so I don't have to wait 5 days to buy a handgun. I am traveling to Mt and asked the Id Mt question because I want to shoot my new handgun in Mt with a friend.

I will always believe the safety of concealed carry is weak because most criminals approach with weapons drawn, I have posted many stories outlining that scenario. Some of the highest trained people in our nation have been gunned down and never had a chance to unsnap.

29. OK...
guns in bars is a bad idea, I get an opinion outside the NRA talking points correct?

You get all the opinions you want, but unless you support them, they're nothing but wind. Why is carry in bars such a bad idea? The majority of states allow it, and it's still illegal to drink while carrying. You didn't address my question, which was whether you would trust yourself to carry in a bar. Do you think you would snap? Would you get drunk and start shooting?

I don't carry a weapon, I use my permit so I don't have to wait 5 days to buy a handgun. I am traveling to Mt and asked the Id Mt question because I want to shoot my new handgun in Mt with a friend.

So you use a carry permit as a convenience, but you oppose carry. That's your choice, but it's hypocritical of you to invoke your carry permit as evidence that you are not an "anti," since opposition to concealed carry puts you pretty clearly in that camp. You want to shoot in Montana with your friend? Great -- you are a law-abiding citizen and should be free to carry your gun there with you, without worrying about a patchwork of arbitrary laws that create new legal jeopardies every time you cross an imaginary line in the sand. How do you like those NRA talking points?

I will always believe the safety of concealed carry is weak because most criminals approach with weapons drawn, I have posted many stories outlining that scenario. Some of the highest trained people in our nation have been gunned down and never had a chance to unsnap.

And there are many stories that demonstrate just the opposite. There is no set script for violent encounters, and they play out in a variety of ways. You choose not to carry concealed -- fine. But you seem to be suggesting that no one should do it. Why not allow people the choice?

9. They certainly created a complex procedure for removing a rifle from a trunk:
he took the rifle to his apartment ... and asked another man who lived in the complex for help getting it out, the affidavit said. That man was not identified by police.

The man held the trunk open with his right hand and grabbed the barrel of the rifle with his left, the affidavit said. Santana held the rifle stock, the affidavit said.

But as they lifted the rifle, it discharged.

I wonder how the police officer was able to write that story down with a straight face...

14. After reading the story, I agree.
It's a .22. Very few weigh so much that it would make any sense at all to have 2 people lift it out of a cars trunk. It would be like needing two people to remove a baseball bat. Why even ask for help at all?

I can think of at least two scenarios, one of which would be negligent manslaughter, the other would be homicide. In either case, it makes sense for the police to hold the rifle owner on manslaughter charges while they investigate things a bit more.

20. Depends on the car
A heavy trunk lid with defective lift supports and no available prop rod can make it a two man job .

unless you can point to stats that say otherwise. I think it's just that instant world-wide communication means you hear about more of them more frequently.

16. Is it possible the man is...
...disabled in some way that would make it difficult for him to get a rifle out of a vehicle? Just tossing out there because honestly I can't see how a .22 rifle could otherwise require two people to remove it from a vehicle...
