Ninth Circus does it again
Appeals court reinstates wrongful death suit against gun industry

A federal appeals court Thursday reinstated a wrongful death lawsuit against the gun industry in a decision expected to re-ignite debate over legislation immunizing gun makers from being sued for crimes committed with their products.

Christopher Renzulli, the attorney for Glock and the RSR companies, said the Glock that the gunman, Buford Furrow, used to kill letter carrier Joseph Ileto was originally sold to the police department in Cosmopolis, Wash., by the RSR companies.

According to court records, the police department sold the weapon to a gun shop in exchange for a different model. The shop sold it to a gun collector who is alleged to have sold it to Furrow -- an ex-convict prohibited from purchasing weapons -- at a gun show in Spokane, Wash.

"How are we supposed to monitor a gun after we sell it to a law enforcement agency?" Renzulli said.

Echoing this frustrated sentiment, UCLA law professor Eugene Volokh quipped, "According to the Ninth Circuit, Glock has to dictate to the police how to handle , because they would know better than the police how to prevent crime."

3. Yeah but the gun show loophole bills that are trying to be introduced
are nothing more than a bandaid for a broken leg. And they cant pass a real bill that would mend the broken leg because the republicans wouldnt go for it.

well, YES!

manufacturers of bullet-proof vests, tasers, riot-control gear, pepper spray, and so on don't just dump their wares at the police station and say, 'you guys figure it out, we don't know how to use this stuff.'

get real. for any other product, crime prevention stuff included, there's a company that gives instructions on how to properly and safely use the product. and yes, the manufacturer DOES, or at least should, know better than the police how to best use the product.


that being said, i have no idea as to the merits of the case. i just know that glock's argument that they can't know better than the police about their own product is just a crock.

4. I think what they are saying is
that once the police buy the gun they dont have much control over what the police decide to do with it or who they sell it too.

Now we see why the corrupt gun industry is trying to engineer a disgraceful liability waiver for itself...

"Survivors claimed that several weapons companies produced, distributed and sold more firearms than legal purchasers could buy. In addition, they claimed the industry knowingly participated and facilitated an underground illegal gun market. "

Bullshit, there are plenty of Democrats who are in support of this legislation. If of course you are talking about S. 659 which has at least 9 Democrat co-sponsors and which the house long ago passedit's version by a better than 2 to 1 margin of 285-140.
