Proof "thinking like a lawyer" is going to make me (more) annoying:
At the grocery store tonight, I wondered if, when I opened the freezer door and about half a million individual peas came tumbling out, I would be liable for negligence should someone get hurt if I did not report the mishap in a timely manner. I thought about it using the objective standard (what a "reasonable person" would do in that situation). And then I thought that many "reasonable people" suck, and I bet a jury would hold someone liable for something that the individual members may still do and not admit it.

I am willing to bet my SO is happy I did not go grocery shopping with him.

(I reported the avalanche of peas, just in case.)

9. Nope...but it is the student group that attracts the future ambulance
chasers (as well as the future ethical trial lawyers).

6. We've only touched on negligence, so yeah...I've got a long way to go...
I did spend a good amount of time at the grocery store deciding that the objective standard (in any legal context -- torts, contracts, whatever) really does require a suspension of disbelief. It's really the *ideal* standard -- ideally, a reasonable person would believe X, but many many people suck and some of them are going to end up on a jury.
