Rush Limbaugh's attorney Roy Black asked a judge Wednesday for copies of all of Limbaugh's seized medical records so that he could develop a list of documents that he thinks should not be turned over to prosecutors.
Prosecutors are seeking the records in pursuing a criminal investigation into allegations that the Palm Beach resident illegally stocked up on prescription painkillers — a third-degree felony called "doctor shopping."
Before releasing records to prosecutors, Black wants to prepare a log, identifying any document that he thinks is not covered by the search warrants used to obtain the records in 2003. Black asked for one week to prepare the log, which will contain an explanation of why each document should remain confidential.
Circuit Judge Thomas Barkdull is mulling over a method of determining what portions of Limbaugh's records will be released to prosecutors. Barkdull denied a request by Black to return all of the records Wednesday.
