I want to seize my neighbor's property

and I am afraid this means I am a bad person. I DO NOT believe in asset forfeiture for victimless crimes. But damn, this woman needs to be removed from the neighborhood. We are all fed up with her.

The cops "Can't find her" even though I saw her in her yard yesterday. They were at her trailer last week; it was full of stolen VCRs, guns, etc. She likes the crank, the crystal meth, and she's already lost her three kids because of it.


Now, she can blow that shit up her nose all she wants or pop it in her veins all she can stand, but abandoning your kids for it and stealing from the rest of us for it make this a different issue altogether. I want to kick her ass. She knows this. She stays away from my end of the woods. But i want her put away, and I want to turn her nasty corner of hell into a playground/garden for the neighborhood kids. What are the possibilities? Do they seize real estate?

Am I bad to want to turn the whole mess to something positive?

1. Please keep working with the police
IMO your best bet for getting rid of her is to get her busted for drugs.

Have you contacted the feds (i.e. the DEA)? If local police are lax they may be able to assist or advise you.

4. One of my neighbors is related to law up here
But we are in a very rural part of the county. Those poor LA folks can't be everywhere at once and there are bluffs and caves and many places to hide.

But I still want to kick her ass.

And burn or drag off the trailer and let the community make something nice out of what she squandered.

5. It's so sad when kids suffer
My daughter and I had planned to start taking our horses down to let her kids ride. I felt so sorry for those kids.

That's what makes me want to kick her ass. But she and her band of crankers have been taking four-wheelers into the woods and stealing from people for two years now. It's getting old.

9. Enough complaints- including getting local media involved
can move mountains. But eventually something will happen. I would not last 10 minutes as an outlaw - i am so inept.

Yeah, I can't get away with jack. I learned a long time ago that some folks get more leeway than others.

This gal has had WAY more than her share. I used to stop and offer her help. Now when I see her I get such a negative reaction, it ruins my mood for a while. The other neighbors feel the same way. I won't repeat the name they call her.

When I lived in Baltimore, a guy broke into several apartments in the neighborhood and was later caught with a bunch of stolen merchandise. The guy who lived below me had a bunch of stuff taken.

When the cops arrested the culprit, he found out that they raided his house. He talked to the PD when he went to identify his stuff. His girl was a part-time prostitute, full time crackhead, as was he and they lived in filth. The place was full of roaches and rats and other vermin. Their baby was covered with sores, had severe skin infections from having the same diapers on for days at a time. Apparently these people left their infant at home alone for days at a time. They had rotting food left all over the place, and had an assortment of pimps, crackheads, junkies staying their too. Human feces was found in buckets.

This wasn't the result of poverty---there are a lot of very poor people who take care of the homes and kids----this was the result of utter depravity and lack of self respect.

If she's in jail, she may lose the property anyway. Now as far as getting the local police interested or getting evidence, you're in the best position to know.

I do know people who are hazards to their neighbors, including an handyman I used to use. Nice guy, but he was a junkie and stole every bicycle and lawnmower he could get his hands on.

but these people are like rats. They scurry around and evade capture.

LOL about the neighbor. We always have SOMEBODY here ( which is annoying sometimes but keeps us from being robbed) but everyone else has lost tractor batteries, guns, TVs, ATVs, gas, and even a deer stand. they tried to get the deer camera, but my neighbor had it screwed in so good, it ended up snapping their picture but never came off the tree. Ha!

the handyman junkie in my neighborhood was a trip. He did some good work for me before getting strung out, including a sump pump system, an outside water line, and a carpeted basement with subflooring. Then when a tenant moved in, he stole her bicycle and when his parents kicked him out, asked if he could move in with her(!) I'll never do that again.

6. Call the zoning inspectors
and have them inspect her for violations. That can get things rolling with other agencies.

While you're at it, turn her in to the IRS. If she has so much stuff, where is the income that supposedly paid for it, and where are the taxes she should be paying on that mythical income?
Remember, they finally got Al Capone on tax fraud.

If you're ever in Monteagle, Tennessee, have a look at High Point Restaurant. That was his hangout in the day. These hills are great places if you need to hide out from your enemies...but woe is you if they catch you.

She's just a common thief/addict. They'll get her eventually, but I don't want her to ever come back once they get her. How do we get her land?

if Walmart came near. We like the woods. She only has about an acre cleared, maybe a few more in the back. It's in a perfect spot for a playground.

10. It takes a big effort before they will sieze her real estate.
She sounds like small potatoes compared to the people who get their property siezed (see RICO lien).

Does she lease the space or does she own it? If it's a lease, her activity may constitute a violation of the lease terms, so try the landlord. If she owns it, is it mortgaged? If she's making her payments on time (or if she owns it free and clear), there's not much you can do except make her a cash offer.

If she's done you pecuniary harm, and the court can award you a judgment, you can always try to perfect the judgment by foreclosing on her assets. But you have to get in line behind her other creditors first.

I passed my idea along to another neighbor and she knows folks who might make it happen. I'm also going to talk to another neighbor who is a mover and shaker and see what we can do. Your angles help greatly.

17. I work in commercial real estate.
I once did some title work on a bar downtown that got siezed as a result of a RICO lien. It was the culmination of a ten year FBI investigation. The police report read like a crime novel - drugs, prostitution, violent fights, everything. When they finally had enough to go after the owners, they made the arrests, and siezed all their assets.

I think the best thing you can do right now is find about this person's property. Who owns it, who liens it, and whether she's making her payments on time. From there, you'll know what options you have.

I know with vehicles, they seize and auction off what the law doesn't want. I wonder if the victimized neighbors could file a suit against her for dameages and be awarded the property, if she was the rightful owner.

Seriously.

I see so many of these rural folks bitch about how corrupt the cities are with the Crack and the Herion...

....stop worrying about our Urban areas and start checking in on your neighbors & kids tweaking on crank. Of the 3 drugs I mentioned - Crank is the toughest one to clean yourself up from. Studies show a 6% sucess rate of cleaning up from crank!

That stuff is nasty once you get addicted. I believe in Live and Let Live, but crank seems to impact even those who are strangers to the addict, in larger and larger concentric circles that never end.

I watched the documentary "Crank: Made in AMerica" and it was just scary. It was like this one entire family was all adicted to it with grandma injecting with her sons while the grandkids watch on (grandkids who if they aren't pulled from that family would be future addicts themselves)

those Meth labs are very, very dangerous. And they are toxic---they spew out all kinds of nasty chemicals

But the main danger is that they are more explosive than a box of dynamite sitting on a furnace---they could take her house, and your house and anything else near by with it.

but no one can tell me that meth labs should be anything but highly illegal. They are dangerous for anyone nearby.

Besides, meth and PCP particularly make people f-in crazy. They are very violent drugs.
Addicts of hard drugs are very dangerous to a community---they will rob, burglarize and in some cases kill if they have to just to feed their habits.

23. San Diego Co. Sheriff tested everyone brought to jail not long ago
Something like 70% of people arrested and held overnight or longer tested positive for amphetamines during a one-year test in the late '90s.

About 80% tested positive for alcohol.

People are cooking meth everywhere now. In fancy subdivision houses, car trunks, hotl rooms. It's really sad.

My mechanic friend had a car dropped off at his former dealership shop. The gal took a loaner and never brought it back. When the cops finally opened her trunk, lo and behold, a mobile crank lab! Guess she forgot, huh?

And property taxes are due. No, she's not quite the civic-minded one, although before she got messed up (again) with the geekers, she did have her girls in scouts.

How sad that a mother would trade her kids for that dope, huh? And that we can't fund more treatment centers so that men and women could have a decent chance of getting off the stuff.

that you may be able to easily get the property through sheriff sale...In fact...check to see if it isn't already up for sale...many times properties go untaken...but who knows how much debt she has against the place.

They are big bible bangers- they hold brush arbor meetings in the summer, microphones blaring the Revival Message. Thye may own her bit as well.

To their credit, they refused to take her kids this time. It had to have broken their hearts, I would think, but they realized she needs a hard wake-up call.

an anonymous tip to the local narcotics division.

the judge will execute a search warrant on that basis nine times out of ten.

asset forfeiture (if she is manufacturing/dealing/using) will more than likely occur.

however, the disposition of the real property after that will be in the hands of the local government or law enforcement (think auction).

39. If her property was obtained illegally (via sale of stolen goods)
then maybe. Or, under a RICO action. However, the property will just go to the State (who'll deal with any mortgageholder, and likely turn it over to them for a pittance) to sell. You probably won't get a playground out of it.

She's an addict, nothing is more important than her supply line. Addicts like that always have friends. She's into the most hard core stuff. If you look like an obsticle to her getting off, she, or more likely her junky friends will step on you. Addiction is invasion of the body snatchers. Please be careful.
