I just heard Elaine Kehano on CNN say this!! Didn't I hear Russ Feingold blow that out of the park yesterday?? God, they are desperate. I wish we had a real media to challenge them instead of read their talking points. And no mention of the Pentagon domestic spying yet this AM.

1. Remember
There is a provision that states in cases of emergency, wiretaps can be issued while court approval is still pending for 48 hours (or something like that).

So, even if the courts are slow, that is no excuse.

but in over 3 years Bush hasn't brought a single terrorist to justice in this country? No Osama, no Mullah Omar, no one? It seems they've had plenty of time to do things within the law. Breaking the law certainly hasn't helped.

Heard & read in several places that the surveillance can start IMMEDIATELY as long as the special court's approval is obtained within I think 72 hours. If the approval is not granted, than the information already obtained has to be destroyed.

start immediately without a Court order -they can do the eavesdropping for 3 days without a court order under current law! Thet did not need to break the law.

They must get an order within 72 hours of starting.

And they refuse to do so.

And it is a Court that never says no to the administration (the secret FISA Court).

Feingold is correct - the law is clear.

The NY Times only error was in not reporting this during the 2004 election campaign - and in buying the National Security/inherent power of the King idea.

Elaine Kehano on CNN is a liar - or right wing GOP controlled CNN is a whore network - or both.

get a secret warrant in 15 minutes and if that's not good enough, you can do your thing immediately and then request the warrant within 72 hours. He smacked down O'Reilly with this last night. I wish I had heard the whole segment but only caught the last minute while channel surfing.
