Can a Whore Be Raped?
I'm serious here.

Can a prostitute be raped? By many people's standards, I guess not.

I ask this simply because of the hypocritical "outrage" by many (mostly men) that the alleged victim in the Kobe Bryant case in Colorado may have actually had sex just before being with Kobe...and with different men. So what!

None of us knows what truly happened there yet. I am willing to wait and see what a trial may reveal.

But just because a woman has had sex with someone other than the person she accuses of rape is really no one else's business.

Following such ill logic, a prostitute could never seek justice in an American court after being raped, for after all, she could have had sex with other "different men" in the same time period as her rape. We had all be very careful that we don't accept such a dangerous concept.

Perhaps Kobe's attorney has some viable evidence and I'm willing to keep an open mind, but the comment that was thrown out gratuitously last Friday about the alleged victim having had "sex with three different men in three days" was outrageous and shameful. I can not see how that comment could possibly help Kobe.

as whore canard. It's virtually the same thing as saying "she asked for it." :eyes:

As for your question, of course a whore can be raped every bit as much as I can.

That’s why this Kobe thing is such bullshit. The victim was supposed to be abstaining prior to the rape; well life just doesn’t work that way.

Nice choice of words, by the way.

The way the "sex with three men in three days" could possibly help Kobe is that it raises the possibility that she could have incurred her injuries with one of those other men.

Yes, but at the same time Kobe's defence is just doing their
job and that is to sow doubt on the charges. The prosecution has some other problems. Some of the answers she gave the first law officer to interview her are not particularly helpful to the prosecution.

It's going to be a case of who is more believable so both prosecutor and defence have to build up their credibility and destroy the adversaries credibility. It happens every day in courts all across the U.S.

(and we're totally leaving aside the question whether Bryant committed a crime).

This trial is going to rely on creating some nasty images of women, just because there are lot of big companies that have have made a huge investment in Bryant (again leaving aside the question of guitl).

But this will fit nicely into the the current tone of a American society, where it's OK to ellect a Nazi groper governor of California and the first lady has an empty head, and everyone's so excited about the sock stuffed down the front of the president's flight suit, and the womens soccer league is a victim of the bad econonomy, but the wealth of the 400 wealthiest Ameircans isn't, and the big debate on Hardball is who's more masculine Dean or Bush.

9. It's a multi level defense
here are the problems it creates for the prosecution:

1. makes the girl seem uncredible - someone having frequent casual sex and wearing dirty panties is not seen as someone who is respectable

2. raises questions about the physical evidence - who's semen is this? What is with the hair? It would be interesting to see if the DNA of the hair is the same as the DNA of the 2ndary semen.

Boy, that defense attorney of Kobe's is either stupid, crafty and evil, or a combination of the two. Mentioning the accuser's name five times in the opening argument--and then wanting to introduce evidence that supposedly made anythig that happened subsequently "no big deal"?

If THAT'S all she can come up with for a defense of Kobe, I'm really starting to wonder...

regardless of any other factor.

As for the implication of "sex with 3 men in 3 days", from what I've read, the woman in question showed up for her rape exam "wearing panties containing semen from another man." Not Kobe. It appears to me the implication being that she had sex with several partners, including Kobe, and for whatever reason came forward with rape charges, and to bolster her claim of rape she donned the "evidence".

I don't know what the truth is, this is just the impression I get from the info seen to date. I truly wish the whole thing could go on without a media spectacle, it's lose/lose for everyone involved.

and equally obviously it does have some relevence. Instead of a situation where you had physical evidence of rape and only one partner you now have evidence of rape and two partners. That is somewhat different.

I think both sides have said some pretty scary things here. Kobe defenders have said some sexist nonsense that makes one ill. Kobe attackers have been pretending that the fact that it is highly unlikely that rape victims lie means that it is impossible she is lying. Like you, I have no earthly idea what happened. I want there to be a fair trial, preferably with a racially mixed jury, and then I am prepared to accept the verdict.

13. it is important to the case-
the prosecution is pointing to cuts and abrasions to the woman's genitals to say that the sex must have been forced and that kobe did it. three different men in three days means two men that could have left those marks that are NOT kobe.
