and also on what the instructions were.

disclosure of classified information requires not only the appropriate clearance, but also a "need to know". if libby didn't "need to know" about plame, then it's not legal for cheney to discuss it.

more severely, if cheney's instructions to libby were, hey, go leak this, then THAT is obviously seriously criminal.

so at a minimum, cheney's lawyer needs a good story as to why he had a legitimate need to tell libby. the fact that libby eventually (further) leaked it is prima facia evidence that cheney told him in order that he should leak it. if cheney can't come up with a plausible alternative story that's completely legitimate, then he's got a serious problem.
