Protecting their own. According to Roll Call (sub.req.): The Free Enterprise Fund is set to start running "saturation" anti-Ronnie Earle TV ads in Austin before taking the ads nationwide.

2. To what end?
It isn't like he's trying to get re-elected.

It's an exercise in making it difficult to empanel a jury, if anything.

Desperate men will do desperate things.
Majority of the public are waking or have woken up. The corruption was "in your face" in the response to Katrina (crony hiring for head Fema, for example). He may be digging a bigger hole for himself with the people, putting out negative ads against the prosecutor. So transparent, really. People aren't really as blind as they were. Some (the base) will always be blind, but that's not who he's trying to manipulate, so IMO, I don't think it will work.

I'm with the other poster. If it DID work, I'd lost faith, too.

35. That's the point ...
Austin is the most consistently democratic part of TX. Pretty much any other part will have a higher RW % (except maybe yellow dog east TX and that has slipped). If he can taint the jury pool he has a chance to get a hung jury at least.

Problem for Delay is that the overall picture could be turing against the Repugs in general, so his sure thing is fading fast. If a change of venue is sought, the delay could hurt Delay (love the irony). As the level of sleaze surrounding this misAdministration grows, not jury pool will be safe for any of them, especially the Bugman.

3. I don't get it. What is the point of the public not liking Earle assuming
the public will buy into the smear? does a grand jury indictment gets overtrown by the public opinion?

What good would it bring Delay?

9. It seems like it could be an attempt to poison a potentual jury pool.
If these things run, and I were Earle, and this goes to trial, I would petition for the trial itself to be moved to some place like Amarillo or Corpus Christi, if it were to remain in Texas.

58. Lawyers outher: Couldn't the prosecutor argue that since Delay himself
poisoned the Jury, it shouldn't be moved? AND since the public will probably research some data 'cause the ads awakend their curiosity, wouldn't the facts just turn potential jurors agains Delay?

I must be dumb, but I still don't get what Delay's real goal is with this move!

60. Lawyers' argument
Exactly so. A defendant CANNOT profit from his own wrongdoing. For example, in the Manson trial, ol' Charlie held up a newspaper in court for the jury to see with the headline "Nixon says Manson Guilty" (paraphrasing, forgot actual headline). Of course the defense asks for a mistrial, and the wonderful Vince Bugliosi successfully argued that because Manson himself brought the headline to the jury's attention, he could not prosper from his own wrongdoing. The argument sure worked; you see where Charlie is to this day!

19. Tampering w/Texas jury pool? OK. Let's move his trial to Vermont!
Picture that good ole boy having to face a jury of Yankees! Maybe some newlywed gay persons on the jury?

I think the Texas judges/court system will be very offended by this. It's a terrible precedent to allow this - among other reasons it means that other criminal defendants w/ money for advertising (such as successful criminals/drug dealers/etc.) can pull the same stunt.

God, the counterads could be so much fun. I'm sure people at the DCCC and MoveOn are high-fiving themselves today.

Talk about an opening to run some anti-DeLay ads that expose the pig for what he is, with some chance to use hyperbole and stereotypes.

DeLay just scored an awesome own goal. "Tom DeLay- THE corrupt Texas politician."

56. Tone DEAF IDIOTS!!!
From the RC article:

FEF, a conservative, Washington, D.C.-based think tank, declined to disclose the cost of the buy, but said it would run for seven days in Texas’ state capital, where Earle is based, before branching out to other media markets around the country.

“It will run so much, the only way Ronnie Earle will not see it is if he watches PBS, because they don’t let you run ads there,” said FEF Vice President and Political Director Peter Roff.

The 30-second ad features a barking, salivating Rottweiler, with a voice-over that recounts Earle’s alleged prosecutorial misdeeds. It ends by flashing the district attorney’s phone number while encouraging people to call Earle and tell him he’s wrong.

“A prosecutor with a political agenda can be vicious. When liberal Democrat Ronnie Earle went after Republican Kay Bailey Hutchison, the judge threw out the case. But now Earle’s after another Republican, Tom DeLay,” the voice-over begins. “Earle’s even exploited the DeLay case to raise money for liberal politicians. That’s wrong. Bad, Ronnie, bad.”

57. Next stop: The Book Tour
An innocent man would leave his defense to his attorney in a court of law. Delay clearly knows he is screwed in that regard, so his next step is turning a failed political career into a career as a GOP martyr. There will be interviews from his prison cell, his family crying on TV asking us to pray for him, a book and corresponding book tour and proclamations that he will devote the rest of his life to proving his innocence and exposing the conspiracy to take him down. Not to mention a radio show courtesy of Clear Channel and/or a show on FAUX news. Fundies and other right ring freaks will eat it up and he will continue to live the good life, promoting the Republican agenda just like the rest of the criminals in the GOP.
