If Renquist is Deep Throat...
tell me if I am wrong but if Deep Throat is Renquist SCOTUS decisions
concerning "Executive Privilege" may be tainted. I don't know but I am speculating here, but didn't the SCOTUS decide some cases involving protecting or releasing Presidential documents? What were the votes? And more importantly, if Renquist is DT, were there not some "conflict of interest" decisions made regarding Presidential issues? Help me out here lawyers. I may be blowing smoke but in the back of my mind I seem to remember some hairy decisions about protecting and/or releasing Presidential records which even impact on what the Bush administration can hide today. This could be much more important than just the identity of DT.

1. Good Question
I would send an e-mail to Keith Olbermann at Countdown
He is having John Dean on tonight. He might be able to answer your question

2. I Can't Answer Your Question, hector459,...
...but I can cite a bit of history regarding Renquhist. When nixon was sued to release the White House tapes in (I think) 1973, Renquhist recused himself from the case, and the court voted 8-0 to order tricky dickie to turn over the tapes.

4. Rhenquist recused himself from the Nixon tapes case?
Sounds like the crafty old devil had a conflict of interest--like being the guy who leaked the Nixon scandals to the press.

Well, at least he had the decency to recuse himself, unlike Scalia-the-duckhunter who thinks it's okay to bag ducks with the VP and still hear Cheney's case over releasing secret energy meeting transcripts. Sheesh.

10. But he never recused himself from subsequent decions about Exec Priv.
At least I can't recall that he did and the ones concerning Clinton's administration and the current Bush administration protect THIS Bush administration. So it would still be a conflict of interest if he had anything to do with helping get rid of Nixon, and setting the stage for GHW-Bush to become VP and subsequently President.

11. He recused himself
from the first case the SC heard. In the next two, he was in the minority in 7-2 decisions. The reason he recused himself in the first decision was not because of anything having to do with Watergate per say. He was the Assistant Attorney General in the Nixon administration, and had taken part in the discussions and plans for the administration to maintain control of specific documents, etc.

Far more important was the fact that in both the confirmation hearings to put him on the bench and to appoint him as Chief Justice, he is known beyond any doubt to have commited perjury. Specifically, he lied about writing a memo advocating a return to Plessy v Ferguson.

16. In theory
he could be charged with perjury for his 1986 lying under oath. As Vince Bugliosi wrote, "I, for one, believe that Rehnquist should be making license plates, not sitting as the Chief Justice of the land." (The Betrayal of America; 2001; pg 86)

5. It's most likely Fred Fielding,

assistant WH counsel under Dean, went on to serve in the Reagan
WH, may have continued to feed Woodward info.

Don't know his current health status, but if he is very ill right
now, then he would be a very good guess.

17. Realized tonight after seeing clip of Hal Holbrook (actor's name?)
That Fielding minus several pounds and about thirty years might have been a "good likeness" for the actor that plays DT (Woodward claims he was a good likeness to Throat)

Wonder where we could get some old photos of Fielding?

28. Here is a collection of Throat suspects
including Fielding, all photos circa 1970s,

http://rchmnd-mediaserver.comm.uiuc.edu/ramgen/media/mugshots.rm

My other favorite is David Gergen, but as of now, he is not sick
or near death. Most of the others suspected were not privy to all
of the information that John Dean was privy to, but Fred, as John's
Deputy, might well have been.

6. Deep Throat most likely worked in the WH & was in a position to
observe the executive branch, according to "Unmasking Deep Throat", by John Dean.

Nothing is more important than placing Deep Throat with his "sensitive" job within the Executive Branch. It is essential to determining his identity, for it limits the potentials significantly. While Woodword and Bernstein do not volunteer the fact that Deep Throat worked at the Nixon White House, the information he provides makes this conclusion inescapable.

Other excerpts in this regard:

-- Deep Throat's information often related to inner workings of the Nixon White House that would not have been known by anyone other than a person working there.

-- Only a WH aide could describe the mood in the Nixon White House during Watergate or the reaction of another WH aide to a Woodward story.

-- In their November 8, 1973, Washington Post front-page story, Woodward & Bernstein identified Deep Throat as a "White House source".

Also, Nixon appointed Rehnquist to the Supreme Court.

14. In today's political climate, Bush Sr. would be hailed as a hero.
As much as I've read about Watergate, I've never seen Bush Sr.'s name as a DT candidate until recently. But then, we didn't know as much about the BFEE until the last four years, either. GHWB's having a nitwit for a son has opened up a huge can of worms in regard to curiosity & discovery about their family, hasn't it.

For numerous reasons...but I don't think it's him, he would be more likely to set one of his cronies up to do it. The way he operates I doubt he personally, would have ever taken the chance.

7. It probably isn't Rehnquist, but if it is....
Then it will be very clear that GHW Bush helped get rid of Nixon in order to clear the path for his own dynastic ambitions, and it will make the SC decision about the 2000 vote look even worse than it does now.

I can't believe it's Rehnquist. I suppose you are thinking of him because Deep Throat is said to be very ill. We need to find out the health of the other suspects.

20. Gerald Ford
I am leaning towards Gerald Ford as Deep Throat. And here's why.

I don't think Rehnquist was honorable enough to be Deep Throat. He was too much of a loyalist concerned with walking the Party Line.

I think it may be Gerald Ford, and here's why. Gerald Ford was widely respected as someone who was basically a good, honest, decent man, even if you don't agree with him politically.

When he was President, he wasn't responsible for any great achievements. But he helped to restore faith in the government after the Nixon era.

Now having said all that, there has always been one question about Ford that was never answered: did he and Nixon have an agreement, whereas Nixon would resign, thus letting Ford become President, if Ford would agree to pardon him?

That has always been open to debate, and there was never any evidence that they had such an agreement.

But basically Gerald Ford has long been respected as someone who knew how to do the right thing, even if it cost him politically.

AND, he has not been well. He was not able to attend Clinton's library dedication, or Shrub's coronation.

22. All very logical, but how about DT's vices of Marlboro and scotch?
I don't really ever remember hearing about Gerald Ford being either a smoker or a drinker.

Hey maybe Deep Throat is really Betty Ford.
