The FCC has filed a remarkable brief in the broadcast flag challenge pending before the DC Circuit. (Public Knowledge is leading the plaintiffs in this matter.) Some background: Back in November 2003, the FCC issued an order (the broadcast flag rule) saying that all devices capable of receiving a digital TV signal (or storing DTV files) would have to comply by July 2005 with a set of technical mandates.

The broadcast flag rule, distilled to its essence, is a mandate that all consumer electronics manufacturers and information technology companies ensure that any device that touches digital television content encrypt that content and protect it against unauthorized onward distribution.

In order to make this happen, the FCC has established a new and extraordinarily broadregulatory regime that mandates the use of "authorized" content protection technologies by virtually every consumer electronics product and computer product -- including digital television sets, digital cable set-top boxes, direct broadcast satellite receivers, personal video recorders (PVRs), DVD recorders, D-VHS recorders, and computers with tuner cards.

In the context of both the flag rule and the IP-enabled services proceeding that was the subject of Bellhead/Nethead earlier this fall, the FCC has said that it has "ancillary" jurisdiction to act. Translation: "Congress hasn't said that we DON'T have the power to do this, so we're going to go ahead on the assumption that we do."

FCC can't deny that every single time it has made a rule affecting consumer electronics devices it has had explicit authority from Congress to do so. But its brief argues that none of these statutes "demonstrate[] a congressional understanding that the FCC lacks general rulemaking authority over television receiving equipment." ("Congress didn't tell us we couldn't act.")

The thing is, this rule doesn't merely affect TV receiving equipment. It affects everything that RECEIVES digital files from TV receiving equipment as well -- every device inside any home network. It affects the open-platform PC. It's a sweeping rule. And now FCC's jurisdiction to enact this rule is being argued in sweeping terms.

Why should we care about all of this? We should care because if the FCC has the power to act on anything that has something to do with communication, we have only the FCC's self-restraint to rely on when it comes to all internet communications. We should care because we want open platforms and open communications to continue. We should care because the future of the internet is at stake -- the FCC will use its "ancillary jurisdiction" to impose "social policies" on any services that use the internet protocol, and will point to its broadcast flag action as support for its jurisdictional claims.

ESTABLISH FOUR CORE MISSIONS for U.S. military forces:

• fight and decisively win multiple, simultaneous major theater wars;

To carry out these core missions, we need to provide sufficient force and budgetary
allocations. In particular, the United States must:
MAINTAIN NUCLEAR STRATEGIC SUPERIORITY, basing the U.S. nuclear deterrent upon a
global, nuclear net assessment that weighs the full range of current and emerging threats,
not merely the U.S.-Russia balance.
RESTORE THE PERSONNEL STRENGTH of today’s force to roughly the levels anticipated in
the “Base Force” outlined by the Bush Administration, an increase in active-duty strength
from 1.4 million to 1.6 million.
REPOSITION U.S. FORCES to respond to 21st century strategic realities by shifting
permanently-based forces to Southeast Europe and Southeast Asia, and by changing naval
deployment patterns to reflect growing U.S. strategic concerns in East Asia.
Rebuilding America’s Defenses: Strategy, Forces and Resources for a New Century
MODERNIZE CURRENT U.S. FORCES SELECTIVELY, proceeding with the F-22 program while
increasing purchases of lift, electronic support and other aircraft; expanding submarine
and surface combatant fleets; purchasing Comanche helicopters and medium-weight
ground vehicles for the Army, and the V-22 Osprey “tilt-rotor” aircraft for the Marine
Corps.
CANCEL “ROADBLOCK” PROGRAMS such as the Joint Strike Fighter, CVX aircraft carrier,
and Crusader howitzer system that would absorb exorbitant amounts of Pentagon funding
while providing limited improvements to current capabilities. Savings from these canceled
programs should be used to spur the process of military transformation.
DEVELOP AND DEPLOY GLOBAL MISSILE DEFENSES to defend the American homeland and
American allies, and to provide a secure basis for U.S. power projection around the world.
CONTROL THE NEW “INTERNATIONAL COMMONS” OF SPACE AND “CYBERSPACE,” and pave
the way for the creation of a new military service – U.S. Space Forces – with the mission of
space control.

EXPLOIT THE “REVOLUTION IN MILITARY AFFAIRS” to insure the long-term superiority of
U.S. conventional forces. Establish a two-stage transformation process which
• maximizes the value of current weapons systems through the application of advanced
technologies, and,
• produces more profound improvements in military capabilities, encourages competition
between single services and joint-service experimentation efforts.
INCREASE DEFENSE SPENDING gradually to a minimum level of 3.5 to 3.8 percent of gross
domestic product, adding $15 billion to $20 billion to total defense spending annually.

I mean, can we end up buying satellite feed from a foreign county to keep our internet alive and just override Michael Powell?

9. Was a post a couple weeks ago that the DOD has its weapon for disrupting
satellite communication up and running, ahead of schedule.

They control the media via ownership. Likewise, ballot box. Those free thinking analysts at the CIA who refuse to just see it Cheney's way are outta there any minute.

Of course the INTERNET will be attacked.

Do you think all the obnoxious and lewd spam you get happens because porn, Internet RX, and penis enlargement devices are such big money makers? No, like the years of hate radio to prime a certain part of the population for the takeover by neocons and all their values, the explicit spam is for crowd control. We all hate it and it will be used as the excuse to crack down on free speech via the ether. Too many of the people will be all for more control or shutdown of the net because it is full of porn which invades their homes via hundreds of spam messages each week. Mark my words, they will frame the argument as one of protecting the children/family values. When we fight for the Internet, we will be attacked as pedophile pornographers.

We beat them in this recent election. We know it. They know it. We beat them without the media and from a position where most of us have been seriously hampered by poor economic conditions. We beat them via the Internet and we are exposing their fraud with the same tool. Dr. Dean showed us just how useful it is and the junta paid attention. This medium brought them down in the real vote and threatens to bring them down by showing what the media won't. They will not let us keep this tool in our arsenal.

Havocmom's advice, and I am dead serious here, kiddies: learn Morse Code, get ham radios and keep carrier pigeons. Divided we fall.

16. OK, here's something else for your wife to kick around:
Marc Racicot, as governor of MT built a lot of prison space, though the state does not need it. Seemed likely it was a gimme to his corporate sponsors, or at least the ones building prisons.

Marc Racicot is also a Corporate Whore (lobbyist-ENRON) who sold Montana down the river for his Corporate buddies. He also chaired the RNC while also still on the ENRON payroll!. Then, headed bush*/cheney 04, spending much effort to pump up his troops with tails of how the DEMS were gonna steal the election with lawyers.

For the past year, there has been a hell of a lot of major road improvement on rural highways here in Montana, in areas with not much population/traffic. I mean, WOW, we are getting some spiffy roads. Now, sure, many roads have been a bit neglected, but considering the other parts of the highway infrastructure in much worse shape, it got me wondering. Could Conrad Burns be THIS worried about his next campaign? I seriously doubt it.

So we have a mess of empty prison space in places far away from just about anything and we have a bunch of really well done roads, made well for heavy wear.

THAT, my friend, scares me to death. Tell your wife I hope we are both wrong, but I doubt it very much.

The Chinese have the Internet, but only within their country's borders.

The FCC is there to protect the interests of the American PEOPLE, not the American Regime in power.

The public airwaves belong to US, the PEOPLE. We allow the television and radio folks to USE the public airwaves to make a handsome profit and we are left with squat.

I DON'T WANT TO BE LATE FOR THE REVOLUTION, SOMEBODY CALL ME!
