BBV: Citizens to initiate recount of Ohio

WEDNESDAY NOV 10, Washington D.C. -- Consumer group rallying citizens for recounts in Ohio, Florida; voters can fund audits of Ohio and court challenges in Florida by donating to HelpAmericaRecount.org, a 527 tax exempt organization set up exclusively for recount funding.
Getting out the vote is good, but getting a 123 percent turnout is too good to be true. This happened in Fairview Park, Ohio. In Broward County, Florida, voting machines can do the moon walk: They count back-wards, but only on certain ballot measures.

This could not have happened without DU's very own HeddaFoil who conceived of and initiated the 527 organization, HelpAmericaRecount.org. If you want to buy a recount in Ohio you don't need to live there...you do need to be a US citizen and you need to get out your check book. How much is Democracy worth to you...atarting next week no one can stop us from auditing Ohio were gonna get em.

In New Hampshire, voting trends seemed to depend more on which voting machine was used than on what party voters were affiliated with. When asked to produce “zero reports” at poll opening, some Florida touch-screen machines reported votes were already in the system, apparent stuffing of the electronic ballot box. Gahanna, Ohio had thousands more votes show up than voters.
Accounting for provisional ballots has been murky, and anomalies have now surfaced in Cuyahoga County, Perry County, and Youngstown Ohio. Florida optical scan machines in 40 counties had statistically improbable results, which did not exist in Florida touch-screens. Technicians got inside access to a central tabulator in Collier County during the middle of the election, and modem security settings may have been disabled for Diebold machines.

As hundreds of anomalies pop up, citizens are thinking:

Who really won? Don’t know. Gotta audit!

Black Box Voting, a nonpartisan, nonprofit consumer protection group for elections, has been investigating election irregularities for two years. The group has honed in on voting machines, citing problems with internal audit logs, tamperability, improper testing and certification, and bogus results. The group is now calling for citizen-initiated recounts.

The National Ballot Integrity Project is a nonpartisan nonprofit organization that has approached voting machines from another angle: Don’t want ‘em , don’t need ‘em. The organization lobbies for transparency and public accountability in election systems.
Ralph Nader, who earned notoriety for decades as a consumer protection advocate, just wants to know the truth. How accurate are the Diebold voting machines in New Hampshire?

Using a little-known provision in Ohio law, any five Ohioans who did not vote for the winning candidate can file for recounts. In Florida, citizens can file to contest the election, county by county. Black Box Voting researchers are helping to identify key counties with the worst anomalies, for hand counts and other audits, to detect computer intrusions and vote count discrepancies.

Everyone bashed Fredda Weinberg back when I was new to DU, and had just joined Verified Voting.

A story that none of you know is that at the same time that she was being bashed around here, for whatever reasons, she was a bit of a hero for us.

We had committed Dill's signatories to his "resolution on electronic voting" to a database, and had a rudimentary tool for editing records. But Fredda lent her programming skills to us, and built a superb search engine over that tool. I cannot tell you the value that this meant to us. We used it for months, and could quickly pull mailing lists or find individuals for a wide range of needs.

So despite the Fredda bashing that occurred, she played an important role and I totally appreciated it. Can't thank her enough.

We would love to recount every state because in case you haven't been listening it's the voting machines we don't trust. Even if it doesn't help in this election we must do this to safeguard future elections and democracy.

21. I live in Ohio
coincidentally right next to Gahanna Ohio. I would be willing to ask for the recount. How do you go about it and who do you contact. I have also been trying to find someone raising funds for this purpose. We need to contact groups like moveon and true majority also to try and get them to help surely they can raise money quickly for something like this. I have seem them raise a million dollars in a day to place an ad and this is definitely bigger. My husband also voted for Kerry and I'm sure he would be willing to ask for a recount also as he hates Bush more than I do.

Have any instances of similar "possible manipulation" in GOP favor (or heck in Dem favor) turned up in any OTHER races? (Senate, House, state Legislature, etc.) Anywhere?

Is the problematical GEMS central tabulator ONLY used on touchscreen and/or optical scan? Does anyone know if there is a version (any company) of similar tabulator available for hand entry of data from old lever machines?

Looking at the races more closely in my own Dem-majority county tonight, wow, the voters were like schizoid... Went strong GOP for Pres, Senator, Congress -- and ONE "targeted" Legislature seat. Otherwise strong Dem for State treasurer, State Auditor General, and other Legislature seats. Weird. Very weird.

Am going to go to my courthouse and ask for more info about how the votes are tabulated centrally in the county from the precinct paper return sheets, just for the heck of it.

You can't install new technologies and then carelessly assume they work especially when there are documented irregularities and a group of U.S. representatives requesting an investigation, can you?

If they do investigate (at taxpayer's expense) and they do discover fraud and/or incompetence what then?

56. OK, I'm in Washington DC now. And I think we can move on FLORIDA
as early as next week with hand counts initiated by Black Box Voting on behalf of American voters. Just got that confirmed, and unless something gets blocked somehow, I think Florida may be a go and will not dip into the Help America Recount fund, because I think we've got it covered.

If we cover Ohio and New Hampshire, Colorado has to be next, followed by New Mexico. Both places stink to high heaven.

This was a bitch to set up yesterday -- it all came at once, and I had about 3 hours to pull together the details. Kathleen Wynne, a new employee of Black Box Voting, was the one who discovered the 5-citizen Ohio recount technicality. She's from Cleveland, and she rocks.

Hedda had put the Help America Recount thing into place with our attorney, Lowell Finley, just 24 hour before.

Ralph Nader was moving ahead with a press conference, called, invited me to come. I figured everything was converging. The biggest stress was getting the HelpAmericaRecount.org web site operational in time, and it's coming along quickly.

Help America Recount is an entirely separate entity from both Black Box Voting and the National Ballot Integrity Project. Because these two groups are 501c(3) nonprofits, we cannot do candidate stuff, and so the 527 organization was set up specifically for recount funds. Great job, Hedda!

I expect to have two more announcements, one as early as Friday, fingers crossed, and one early next week.

We will need volunteers to help with the hand count in Florida, which it does not know it will be required to do. I know how to muscle them into letting us do it, at no charge, but will need people in about 44 counties to help. If you have volunteered with the Cleanup Crew, make sure we have your address if you are in Florida.

to warn elections officials to disconnect their modems, even after a security consultant gave him evidence that Diebold had disabled security settings on them. Mostly he seemed to be unhappy that we had also reported it to other law enforcement agencies. That, by the way, is not typical for FBI; I've worked with them on two previous investigations.

So, Agent Mike, and FBI guy, hope you're satisfied. It would sure be nice to have you working for the right side on this.

The site is up but, would you believe that PAYPAL is down? Do you think it's because of us? Actually, they have a notice up when you click the "donate" button that says:

(I'm sure "questions and issues" are defined somewhere - but a definitions section didn't jump out at me so I went for use of the phrase in another context.)

Has anyone checked this out with an Ohio election attorney, before we spend vast amounts of time and effort on something Blackwell can legitimately slap down? (In which case, it might be better to know now while we still have a chance to move in another direction - like putting the pressure on Kerry or one of the third party candidates to make the request.)

You would keep these posts in election results(as long as it's still there and we are disputing it-which I hope will be a long, long, time)

I'm already growing weary of having to read in these other forums about how dumb we are not understanding the Christian position and how right Bill Clinton and Carville are. Or my favorite-let's all forget about LAST WEEK and move on to 2008.

The cool people are hanging out there. At least I'm thinking that's the only place I'll be reading on DU besides LBN.

according to the Ohio Dem Party, "only the losing candidate can file for a recount". Please get your facts straight. Citizens can request a recount on propositions. It maybe an audit is possible but NOT a recount. Check with the State Board of Elections before you send money. Check with the ATTy Gen. But check! I want this to work as much as anyone but check the facts!

§ 3515.01. Persons eligible to apply for recount.

"Any person who was a candidate" may request a recount "of the votes . . . for all candidates for election to such office or position."

"Any group of five or more qualified electors" may request a "recount of the votes cast . . . upon any question or issue"


§ 3501.01. Definitions.

(M) "Question or issue" means any question or issue certified in accordance with the Revised Code for placement on an official ballot at a general or special election to be held in this state.


§ 3517.01. Definitions.

(9) "Public office" means any state, county, municipal, township, and district office, except an office of a political party, that is filled by an election and the offices of United States senator and congressman.

(didn't find a definition of position in my quick look)

"Office or position" and "question or issue" are two separate things, with separate recount provisions.

The way I read it is that candidates may request recounts for offices or positions and electors (us) may request recounts for issues and questions.

- But whoever is organizing the recount drive should check with an Ohio election lawyer to be sure... before it is too late to change get back on course if only Kerry (or one of those pesky third party or independent candidates) can request a recount

All Democrats must urge their representatives (RED OR BLUE) to give a vote of no-confidence to the election results out of FL, NC and OH... Tie up the process of officially inaugurating *. We cannot accept results that are known to be wrong - i.e. more votes than registered voters. Insist on throwing out the entire states' results and doing them over - INSIST ON A VOTE OF NO CONFIDENCE IN THE FL, NC and OH RESULTS...
