Ashcroft to be appointed to the Supreme Court


Probably by Thanksgiving.
The story is not cut in stone yet but it is one reason why Spector was oddly speaking out of turn.

He will NEVER make it to the bench.

The man is a confirmation nightmare. His anti civil rights activities as AG make it virtually impossible.

Democrats loathe him almost as much as Bush and it's not like this guy is totally adored by the Republicans either.

He'll never make it. I'd put my money on White House Counsel, Gonzales for the first nomination.

I like this pick of Ashcroft. Do you really think * will pick anyone who is less of a wing-nut? No.

This guy had or likely has cancer. He is older. I fear a healthy 40 year old conservative with no record and the same Ashcroft agenda.

the strategy is that when a vacancy opens up, Bush nominates Attila the Hun, so to speak, expecting him to be rejected. Bush can then come back with a reactionary but slightly less inflammatory choice which is likely to be approved.

I saw this discussed four years ago at the beginning of Bush's presidency.

On Edit: For example, an Ashcroft rejection might be the first stage in attempting to get Estrada on the court.

Ashcroft on the court would not appreciably change the stances since you are trading Rhenquist for Ashcroft, but it would become a PR nightmare for the Bush administration and would terrify the nation if the Democrats said they simply were in too weak a position to be capable of opposing the nomination.

That single move would reverberate throughout multipl constiuencies in the nation and work to the ultimate favor of Democrats.

the Democrats should issue the following statement:

"The Democratic members of the Senate are not in a position to be capable of opposing this nomination."

We trade one rightwing nutball for another. Zero sum gain in the makeup of the court.

The public relations nightmare that will ensue will be worth allowing one nutball to be traded for another, and will shore us up for the O'Connor replacement. Plus, an Aschroft nomination to the court might cause Sandra Day to rethink her position on retiring anytime soon.

They'll go after the Hispanic/Latino vote and try to get someone like Estrada on this time, and then go for the women's vote with Edith Jones (5th Circuit) when O'Connor retires. They'll probably want to go after the Western Latinos or Florida Cubanos, so I'd look to their ranks for the Hispanic token. Where was Estrada from- I don't remember?

I agree, though, with the poster who said they'd put Ashcroft up so that he'll be defeated and then someone equally as opposed to our Constitution can be named easily.
