House Judiciary Committee letter to GAO regarding voting machines
November 5, 2004

Dear Mr. Walker:

We write with an urgent request that the Government Accountability Office immediately undertake an investigation of the efficacy of voting machines and new technologies used in the 2004 election, how election officials responded to difficulties they encountered and what we can do in the future to improve our election systems and administration.

In particular, we are extremely troubled by the following reports, which we would also request that you review and evaluate for us:

In Columbus, Ohio, an electronic voting system gave President Bush nearly 4,000 extra votes. "Machine Error Gives Bush Extra Ohio Votes," Associated Press, November 5.

An electronic tally of a South Florida gambling ballot initiative failed to record thousands of votes. "South Florida OKs Slot Machines Proposal," Id.

In one North Carolina county, more than 4,500 votes were lost because officials mistakenly believed a computer that stored ballots could hold more data that it did. "Machine Error Gives Bush Extra Ohio Votes," Id.

In San Francisco, a glitch occurred with voting machines software that resulted in some votes being left uncounted. Id.

In Florida, there was a substantial drop off in Democratic votes in proportion to voter registration in counties utilizing optical scan machines that was apparently not present in counties using other mechanisms. http://ustogether.org/election04/florida_vote_patt.htm

The House Judiciary Committee Democratic staff has received numerous reports from Youngstown, Ohio that voters who attempted to cast a vote for John Kerry on electronic voting machines saw that their votes were instead recorded as votes for George W. Bush. In South Florida, Congressman Wexler's staff received numerous reports from voters in Palm Beach, Broward and Dade Counties that they attempted to select John Kerry but George Bush appeared on the screen. CNN has reported that a dozen voters in six states, particularly Democrats in Florida, reported similar problems. This was among over one thousand such problems reported. "Touchscreen Voting Problems Reported," Associated Press, November 5.

Excessively long lines were a frequent problem throughout the nation in Democratic precincts, particularly in Florida and Ohio. In one Ohio voting precinct serving students from Kenyon College, some voters were required to wait more than eight hours to vote. We are literally receiving additional reports every minute and will transmit additional information as it comes available. The essence of democracy is the confidence of the electorate in the accuracy of voting methods and the fairness of voting procedures. In 2000, that confidence suffered terribly, and we fear that such a blow to our democracy may have occurred in 2004.

I just got back from an elder retreat from my church. One of the other elders, a very nice lady, expressed her shock and dismay with the situation in Iraq, and from her remarks surmised Democratic leanings. I told her she wasn't the only one, and she was relieved to have a friend to whom she could talk. I invited her to DU, so be on your best behavior, okay?

17. Palm Beach County Logs 88,000 More Votes Than Voters
According to the official election results posted on the Palm Beach County election website, 542,835 ballots were cast for a presidential candidate while only 454,427 voters turned out for the election (including absentee). This leaves a discrepancy of 88,408 votes cast for the presidential candidates.

Palm Beach County's supervisor of elections is Theresa LePore who is known for the 2000 Presidential Election and the notorious "butterfly ballot" that caused confusion among seniors and other Floridians.

Other election oddities occurred throughout Florida with some counties registering a 400% increase in expected voter turnout among Republicans while Democrats supposedly experienced a -60% decline in expected support in certain counties. The 50+ counties experiencing the high percentage fluctuations in expected turnout used optical scan voting machines on November 2nd.

Vote discrepancies were also found in Gahanna, Ohio which gave an extra 4,000 votes to President Bush. The error was explained away by Franklin County administrators as a "glitch" in the electronic voting system.

60. I can personally confirm that. My mother was one of those in line
in Gambier, Ohio. She waited four and one-half hours to vote, because she arrived at 9:30 am. The last person in line voted there at about 4:00 am the morning after election day.

The ONLY reason that the polling place in Gambier, OH was required to stay open for people in line at 7:30 pm was because the students and faculty at Kenyon College were savvy and connected enough to file a lawsuit with the Ohio Board of Elections that morning.

This scenario existed at numerous Democratic precincts throughout Ohio, notably in predominately African American neighborhoods in the large cities. Many of those people were unable to wait in line for six hours or more.

Ask yourself this. We learn about a few cases where the voters were highly educated, affluent, and connected to the establishment. They're the ones who complained and got noticed. In how many other precincts across the country were people too isolated, undereducated, and poor to raise a stink? How many people quietly went home without voting?

And how many of the votes that people struggled to cast on election day were eliminated?

This is about voting rights, voting fraud and the accuracy of the "state of the art" voting equipment. It is not a partisan issue. Crimes have been committed, people need to be held accountable and fraud is apparent. If e-voting with no paper trail was used, the voting in those precincts needs to be declared null and void and a re-vote with EQUIPMENT THAT WORKS should be held immediately. Plenty of voting machines should be availabe from other precincts, so there shouldn't be a problem of waiting in lines. Alternately, absentee ballots could be sent to every registered voter in the questionable precincts with a strict but reasonable deadline for sending the ballots back in.

Last but not least, a MASSIVE lawsuit should be brought against Diebold.

done without consulting Kerry or Edwards. How would you know that they would/wouldn't support the effort? Wouldn't it make more sense to ask them? Quite often in legal cases of this nature, those bringing it have to have "standing." That would obviously imply Kerry and Edwards.

(I would think that even if they for some reason didn't support it, people should go forward. But I think it would be foolish to not confere with them.)

57. We're not just people, we are THE people ....
as in "We the people". The citizens of America deserve to know if their voting system can be trusted. This isn't just about Kerry and Bush. If this election can be rigged, then the next one will be for sure. "We the people" have greater standing than John Kerry. If the attorneys involved have to get petitions signed, so be it, but as a democracy, we must be able to trust that our precious vote is counted and isn't discounted by "votes" that appear out of thin air (or a rigged computer program).

would think that it should be done without confering with Kerry and Edwards. It is also pretty shakey to think that "we the people" have standing in any specific case involving potential voter fraud. It has a very nice rhetorical sound, but is lacking in legal strength.

with Kerry and Edwards. If Kerry and Edwards say, "Nah, we're throwing in the towel", do you think that no investigation should be done? If voter fraud is suspected, it should be investigated. If attorneys representing voter organizations (like the CBC did last time) which to present their case, they should be able to. To not pursue it, just because Kerry doesn't want to, would mean that the voters whose votes didn't count, or who were prevented from voting, just don't matter, AND THEY DO.

So are you saying that they should confer with Kerry and Edwards as a courtesy, or do they have a say in the decision to investigate. Kerry and Edwards may have been wronged, but the voters have been wronged as well. EITHER should be able to make their case. Like I said before, if it's a matter of getting people to sign petitions, then get them signed. If thousands of voters suspect that their votes weren't counted and are willing to go on record as to why, I don't feel Kerry should have veto power over their decision to make sure that their vote was counted correctly.

It only lacks in legal strength because it hasn't been done before, but challenging existing laws is one of the ways that new laws get made.

73. My posts should have made clear
if you had read them that if Kerry and Edwards disagreed, and said they would not be part of this, that people then move ahead on their own. I do not think there is a one in a million chance that they would say no one should do it. But I do believe in having enough respect for them to try discussing it with them first. It should be obvious that if they agreed -- even in an off the record manner -- it could be very helpful.

Having legal standing in a case has nothing to do with if it has been tried before or not. One needs legal standing in order to challenge a specific law. It's not enough to say "we the people think we are right." In a case of the potential significance of this, it's better to take the time needed to find out exactly who can bring such a case. My suggestion would be to contact the Center For Constitutional Rights on Broadway in NYC. It's where Bill Kunstler used to work towards the end of his life. They specialize in -obviously- constitutional law. The people who are leading this movement are doing a good job, but need to make sure they are laying the foundation for a case that will not get tossed out without being heard. A number of people on DU grasp this, a number do not.

If anyone goes to Kerry/Edwards in the *slightest* bit, even in an "off the record agreement" this entire case could be immediately be marked as a partisan idea. Even though it clearly is not about K/E winning or losing, but actually making sure that everything is running the way it should, any involvement from the K/E camp would send the media into a tizzy.

I think it's best not to involve them. Nothing personal against them, but this idea is bigger than any one candidate.

If this is taken to Kerry/Edwards, it immediately gets dismissed as poor sportsmanship on the part of the Democratic Party. No investigation. No follow-up.

NOTHING.

It's going to take nothing less than a miracle for this thing not to get ripped to shreds as it is, I'm just trying to think in terms of what's going to work to get this idea off the ground.

on this. I just see one part slightly different. I'm not disagreeing with the basic idea. But I will say that we shouldn't think of what the republicans might think .... regarding "poor sportsmanship." It is a valid case, and would only be enhanced in its potential standing in court if Kerry and Edwards were involved. But I'm sure that if any capable attorney takes the case, and is looking to have it heard, they'll go in that direction.

I got an e-mail from my neice at Syracuse U. She corresponds with a national figure who sent her some information about the amount of attention the case is getting. It's the same information mentioned on these DU threads. People are moving in the correct direction.

but any monkey knew that...they cheat just enough to put there monkey over the top...Seriously in this age of republican control of all branches of government and seemingly media is there any way to get rid of those cheater machines or at least make them like Nevada w/ verifiable paper trail. You know any attempt to make the system honest will be met with stiff resistance from the criminals.

On edit: I did a Google News search - got responses showing a WashPost/AP article that mentions this letter to the GAO:

I do suggest sending letters of support to all of these honorable gentlemen; but, you've got a better chance of actually being read with a fax or letter.

What is beyond my comprehension is WHY do they not ask for an immediate audit in at least two key states "Florida & Ohio"? Our government should NOT allow this election to be certified and closed until an audit is done in at least the final outcome determining states. They would only have to 1) select several suspicious precincts within at least two determining states for audit; 2) based on those results determine whether the entire state would require audit before closing this election year out and calling it final (what a joke- final? NOT!) with another likely "Election Fraud". After 2000 and now this in 2004? How can at least the sample audit not be demanded?

Is this a democracy or not? If so, at least exercise the minimal!!!

83. With very little media co operation its a dead issuse !
So far from what I've seen ,not only does this story have no legs,it has no body,and nobody talking about it on either side of the fence. I hope someday the media will be called out on how they enabled this white house to kill thousands of inocents in Iraq and some of our best young men and women ,they all have blood on their hands ,and the sickest part of this whole cluster**** is this white house is percieved as having the higher moral standards ! Get ready for a 16 year lock on the white house and perhaps even the senate and house by this grand illusion ! The media gave bush a pass on so many things that would have chopped his high morality B/S off at the knees. They will forever be part the blame for this continuing war for profit control over our goverment !

Of 650 elegible voters in this Ohio County,
Kerry got 240 votes and Bush received 3400.???????
WTF??
Only 650 people could actually vote. Go figure.

I hope someone sends John Cornyn a copy of the letter from Pres of Diebold assuring Bush "he is doing all he canto insure re-election." Haul his sorry ass before a Grand Jury. Make him explain this statement.
I hope Cornyn has a copy of this letter that has been floating around DU for sometime.

84. This is not about partisan politics any more than Watergate was.
The result of any investigation would not be public until after the electoral college meets. The results of the election could not be overturned at that point.
This should be a criminal investigation, about election fraud. Bev Harris warned us. This should have been exposed BEFORE the election, but no one would listen. The fix is in and we have to live with the consequences. The idea here is to remove the fix and all future fixes so that this is not an ongoing problem. The people involved in the fix should all have jail sentences.
