Bush's June Surprise (what do you think of this?)
"The June surprise would be the resignation of U.S. Supreme Court Justice William H. Rehnquist-or, less likely, Justice Sandra Day O'Connor-at the end of the Court's present term, and the subsequent appointment of an Hispanic justice by the president."

I found an article discussing this prospect at
http://www.intellectualconservative.com/article3512.html

What do you think?

1. Bzzzzt
a. Rehnquist would have retired by now if he wanted to be replaced by a Bush nominee. Same for anyone else near retirement.

b. Authors who refer to a judicial nomination by the President as the president "electing" a judge and call the retirement of a justice a "resignation" don't know much about their topic.

3. Your observations are interesting, thanks. Did you go to the link?
It is a website "devoted exclusively to intellectual conservatism". Seems a little ironic doesn't it?

18. The word would be
ox·y·mo·ron ( P ) Pronunciation Key (ks-môrn, -mr-)
n. pl. ox·y·mo·ra (-môr, -mr) or ox·y·mo·rons
A rhetorical figure in which incongruous or contradictory terms are combined, as in a deafening silence and a mournful optimist

2. I think rather than galvinizing the base
It will look a lot more like a last effort to keep himself out of jail, or get re-selected. Bush cannot afford to touch the Supremes again. The whle Cheney Scalia thing hurt Bush.

SCOTUS is the third rail for Bush. Rehnquist better just resign himself to dying in the traces.

I hope the famous Bush loyalty makes him shove Gonzales down the Senate's throat.

4. It's too late for this year.
No way there could be an appointment and then confirmation hearings before the election. This is an election year for 1/3 of the Senate and they will be too busy campaigning to hold hearings of this magnitude.

6. Detainee Torture
If Congress does it's job the Detainee Torture issue will hit BushCo hard. This guy is smack in the middle of that. He has a snowball's chance in Hell of being confirmed.

14. It is not just Gonzales
Because of Selection 2000, SCOTUS is a third rail for Bush.

8. After reading the article I got the impression
that is why they want to do it in June. Distract from what is going on and put Dems in a bad spot.

9. I don't think Bush putting up another
uber-conservative judge puts the Dems in a bad spot, actually.

10. but you are thinking rationally
These guys don't. They believe that everyone thinks the way they do. If the Repugs nominate, then we will freak and be against. They are the party of divide and they oppose anything we suggest, so it just goes without saying that is what we will do.

They have no concern about the judicial system or the country, they just see it as, our guy versus your guy.

11. If one retires and
they don't replace him in a timely manner, they have in effect crippled the Supreme Court..might be a Bush strategy.

13. They are a divide and conquer bunch
Crippling the Supremes and getting the Senate Judiciary Committee to have to worry about the new nominee would be right in line with what they do, muddying the water and dodging the issues.

12. Schumer says that he has talked Rhenquist of out retiring.
So it's not impossible.

15. I was thinking about this earlier
I'm surprised Rehnquist and O'Connor haven't retired yet. I think they expect Chimpy to win another term.

If things look dire, perhaps they'll bail out of the sinking ship. This will be a tell-tale sign that not all is right in the Bush Administration.

Most likely Rehnquist, since he's the more conservative of the two. O'Connor seems a bit more moderate, but has said she would prefer to be replaced by a Republican.

16. Just as Hitler and his cronies
failed to recognize the crumbling of their support until it was too late (thank God), so will * and his posse. Right now they are trying to figure out how to get more press and get the Senate Judiciary Committee off of their backs. Resignation of a Supreme and nomination of a Hispanic can (in their mind) get them the Hispanic vote and get the Judiciary Committee humming another tune. Little trivia, Bush hired the niece of our governor to his campaign as the Hispanic representative. She is Latin American and her sole purpose is to court the Latin Americans to the party.

17. Has anyone noticed the national news links to this possiblity??
This evening ABC reported that if a conservative is appointed to the Supreme Court (should a vacancy occur), then the pledge issue will not have a chance (it still has a chance if another parent files on behalf of his/her child) ....

Then a few stories later ABC discussed the Latin American population growth in our country.

Odd, it sounds to me like they are laying a foundation for the "June Surprise".
