Peter Bacanovic, the former stockbroker convicted of plotting with Martha Stewart to obstruct justice, also will seek a new trial based on Stewart’s claim that a juror lied about his arrest record, a spokesman for Bacanovic said Thursday.

Stewart’s attorneys alleged in court papers Wednesday that juror Chappell Hartridge hid an arrest on charges of assaulting his girlfriend so he could get on the jury. The Stewart defense said Hartridge was biased against corporate executives and wanted to exploit his jury service by selling interviews.

Stewart, 62, argued that Hartridge lied under oath when he was asked during jury selection whether he had ever been charged with a crime, sued or accused of wrongdoing on a job.

Hartridge didn’t reveal his arrest on charges of assaulting his girlfriend in 1997. Nor did he disclose that he was sued three times and forced to resign from a volunteer post as treasurer of a youth baseball league after he was accused of stealing money, Stewart’s attorneys said in their filing.

1. The problem is
how big a role did he play in the verdict. If he was a major factor then a new trial is needed. But if he was a minor player, then the verdict would have been the same with or without him, IMHO.

2. Hung jury
I'm not a lawyer, so I can't say for sure. But if this was a criminal case needing a unaminous decision, then a one juror would have made a difference. All it takes is one holdout to hang a jury.

5. He was the first juror to go on TV
and discuss the case. He said their decision was a "victory for the little guy".
