Agents with the state Bureau of Narcotics Enforcement were in unmarked cars waiting for David Gonzales, a patrol violator, to come out of a house on North 14th Street. Someone who agents say matched his description eventually came out of the house and drove away in a van.
When the driver realized he was being followed, he sped away. Eventually he stopped the van, got out and ran.
Agents chased the man and one of the agents fired several shots at him. The man was hit and died later at the San Jose Medical Center.
After the man died, investigators learned he was not Gonzales. He has been identified as Rodolfo Cardenas.

Cardenas, the father of five, was at least 7 inches shorter and 50 pounds lighter than Gonzales. When the shooting was reported, it was believed the driver walked out of the house, which would have given agents the opportunity to see his size. However, conflicting reports have since been reported that the man was not seen outside the vehicle until after the chase.
The Chronicle reports Aida Garcia, the sister of Rodolfo Cardenas, said she believes her brother fled from the state agents in his van and later on foot because they were in plain clothes driving unmarked vehicles and he was afraid.
