CBS story of teenager getting 10 years for charges of rape
Edited on Mon Jan-19-04 07:02 PM by candy331
In Rome, Georgia an 18 year old Afro-American teenager gets 10 years after being found not guilty of rape but still got 10 years for injury during sex because she lost her virginity. Did anyone see that story? America the great!

1. WTF?
I'm not sure I understand. Could you give a little more detail, because I'm not familiar with the case.

5. Dan Rather brought this story on
a few minutes ago so it may be on the CBS site now or later. The young man was an A student headed to Vanderbilt on a football scholarship. The news said he had sex with a fellow student, interviewed 2 members of the jury and they were horrified said they made a grave mistake they thought that the sex was at the most a misdemeanor certainly not a felony and that they never, never intended this to happen. The boy was adopted as a Young child by a white couple and the father said when his son told him it was with a white girl he cried because he knew what was going to happen, he was crying on the news piece. The news said the DA fooled the jury with the charges and ran awry with it but the DA insists she did nothing wrong but no interview. The case is going to the Georgia Supreme Court as a last hope of release if upheld he will spend the next 10 years in jail for virginity injury due to sexual intercourse.

-snip-

The prosecutor, in what can only be perceived as an act of complete disregard for the law, facts and justice in general, included a charge of "aggravated child molestation". Under Georgia law, if anyone (age of the perpetrator is irrelevant - he could be 15) has sex with a minor (under 16) that results in an "any" injury, he is guilty of "child molestation". The jury deliberated for hours on this charge. In the end, technically, this situation fell under the purview of the statute as written. Marcus, admittedly had sex with the girl, she was under 16 (by three months), and, again admittedly, she was a virgin. It was the fact that she was a virgin that resulted in the Guilty verdict. You see, she sustained an "injury" as a result of intercourse. Technically, he is guilty.

I suppose now they'll have to notify everybody in the neighborhood when he moves.

At least they're not castrating people yet.

9. so this was consentual sex between the two? what is a 'virginity

12. you know how many people have committed this "crime"???
I'd say MOST girls lose their virginity as teenagers (or at least many do) and chances are the boy is someone their age...

it's basically illegal for a girl to lose her virginity in GA???

13. It's only illegal for black boys.
Assuming it's a white girl, of course.

14. How the heck did they prove that she was a
virgin is a question I would like to have an answer to..... Surely no one thinks this is justice.

15. In Texas this would be illegal
because the guy is 18, and the girl is under 17. The charge would be statutory rape. What's the age of consent in Georgia?

Apparently a busted hymen qualifies as an injury.
