Times Reporter Ordered to Testify in Leak Case

A federal district judge in Washington has ordered a reporter for The New York Times to testify before a grand jury investigating the disclosure of the identity of a covert C.I.A. officer.

In a decision dated Sept. 9 and released yesterday, the judge, Thomas F. Hogan, said the reporter, Judith Miller, must describe any conversations she had with "a specified executive branch official." The judge said Ms. Miller had received subpoenas issued by a special prosecutor investigating "the potentially illegal disclosure of the identity of C.I.A. official Valerie Plame."

George Freeman, assistant general counsel of The New York Times Company, said: "We regret that Judge Hogan has denied our motion to quash the subpoena on Judy Miller seeking that she reveal her confidential sources. Journalists should not be forced to testify about their confidential sources when they have done nothing more than aggressively gather news about government actions.''

2. Perhaps Judith remembers Kenneth Starr
and Susan McDougal.
Perhaps her recollections will sharpen as she sits in jail.

Journalists protection of sources in this case, spousal privledge in the other. Of the two, I respect Susan more, because if Judith Miller was a journalist in this case, I have an old dictaphone machine in my basement that wants to claim 1st amendment protection.

I have heard of a number of other journalists being ordered to 'fess up, but not him. Did I miss it?

4. If Novacula is called, he'll have to testify or go to jail.
The judge already squashed the Times' request on Miller. Looks to me like the judge wants to start asking the right people the right questions.
