Bush Blames 'Junk Lawsuits' for Job Woes

President Bush (news - web sites) and rival John Kerry (news - web sites) on Tuesday offered different ways to boost the sluggish job market, the president calling for legal reforms to help workers and businesses while his Democratic opponent proposed ending tax breaks for companies that send jobs overseas.


Kerry, moving aggressively in the face of polls showing his candidacy lagging, used the latest forecast of a record budget deficit to bolster his contention that Bush is leading the country in the wrong direction. The Bush administration described the lower deficit prediction as positive economic news.

However, when it comes to solving problems involving his own family, Bush heads straight to court. In 1999, Bush sued Enterprise Rent-A-Car over a minor fender-bender involving one of his daughters in which no one was hurt. Although his insurance would have covered the repair costs, making a lawsuit unnecessary, Bush sought additional money from Enterprise, which had rented a car to someone with a suspended license. In this case, Bush seemed to understand one of the most important functions of civil lawsuits -- to deter further wrongdoing. The case settled for $2,000 to $2,500.

In a dramatic day of political turnarounds, Al Gore lost a bid to force Miami-Dade County to keep recounting votes, while George W. Bush called on the U.S. Supreme Court to halt the vote counting in Florida altogether.By day's end, it was impossible tosay which side had gained the upper hand, although the legal wrangling and fiery partisan rhetoric left both Republicans and Democrats angrier than ever as the country's search for a president moved into its third week.

Most of yesterday's battles stemmed from the Florida Supreme Court's decision Tuesday night to allow hand recounts to continue in three South Florida counties, with a deadline of 5 p.m. Sunday for results to be reported to state election officials. So far, Bush officially leads by 930 votes.

Bush is hoping to find more success in legal battle, although the U.S. Supreme Court has been extremely reluctant to get involved in state election matters.

The governor's attorneys filed two appeals with the nation's highest court and asked the justices to grant quick review. However, they did not request an immediate halt to the recount.

"This is a case of the utmost national importance, involving the Constitution's most fundamental rights as exercised in the nation's most important election," the lawyers said in court papers. "The outcome of the election for the presidency of the United States may hang in the balance."

Bush's attorneys claimed the Florida justices' ruling unconstitutionally usurped the powers of the state Legislature and that the recounts themselves were too selective to be legal. They also asked the court to review a federal judge's decision last week to let the recounts continue.

12. Uh see if a worker gets hurt and sues the reponsible party....
such as the employer who maybe took shortcuts around safety requirements then the employer can be held accountable and can't just fire the guy and HIRE a new one-thus CREATING A NEW JOB. See?

Only those who have been harmed by an irresponsible corporation and have sought justice in the courts can clearly understand the damage of tort reform to our rights as consumers and citizens. The tort reform movement, which originated in Texas under then Governor Bush, has resulted in loss of our access to hold corporations accountable and is now being touted by "The Reformer with Results", President Bush, as the solution to the insurance crisis across the United States. The history and damage of tort reform, especially in Texas, is significant and should not be overlooked when being considered as the panacea for rising insurance rates.

Over the last decade Texas tort reform groups have relied on highly visible awards to bolster the continued need for lawsuit reform. They fail to note twelve jurors in a civil trial, once guaranteed by the 7th Amendment to the Constitution, granted the awards. And the awards are rendered only after both sides have presented their facts to the jury and judge. They also fail to mention these highly visible awards are few and far between and many such as the much-publicized $32 million verdict against Farmers Insurance in Dripping Springs Texas, are substantially reduced ($4 Million) or never paid.

good faith negotiations have been unsuccessful, homeowners seek the help of an attorney just to learn their Constitutional rights to a civil trial have been replaced with a secret kangaroo court of arbitrators.

During two interim studies conducted by the Texas House of Representatives this past summer, homeowners across the state hammered the use and abuse of arbitration by Texas homebuilders. Contrary to popular belief, binding arbitration in new home contracts is extremely costly, grossly unfair, and is held in secrecy away from public and media scrutiny. Only when a homeowner has a serious costly defect do they realize how horribly abusive the arbitration process can be. The testimony provided by the homeowners at the hearings was undeniable. The use of arbitration in consumer contracts is abusive and does little to protect investments or hold an irresponsible, uncooperative corporation accountable for their actions. Removing the accountability provided by our time honored, civil court system for any industry is risking another Enron fiasco.

"In our lives" what he's really saying is: "Now, you don't mind if Corporations make rancid baby formula or deathtrap cars or housing that blows away with 10mph winds, do you? We can't expect our CORPORATIONS to make safe products, because SAFETY COSTS MONEY. And government workers to actually investigate and prosecute criminal CORPORATIONS cost MONEY."

It's his pet project: after tax breaks for the wealthy, he is intent on giving them absolute immunity from any legal threat. Once again, his disdain for the common American rears its ugly ass. He won't be satisfied until we are at the complete mercy of the CORPORATION.

How convenient that he can wrap up the dismal job market along with the gutting of civil law into a tidy campaign lie.

What a complete jackass....

22. yes and he is doing this with the permission
of his base. Wages fall, jobs get shipped elsewhere, no health insurance, the list goes on and on and in addition he wants to take away other things, like our rights to civil action. But he says nothing about when businesses file "frivilous" lawsuits against other businesses. He just wants to take away rights of the indiuviduals. And when I watch him campaign there are these people cheering him. (Probably all rich business owners)
