Times Reporter Is Subpoenaed in Leak Case

reporter for The New York Times, Judith Miller, was subpoenaed yesterday by a Washington grand jury investigating the disclosure of the identity of a C.I.A. undercover officer to the syndicated columnist Robert Novak and other journalists.

The subpoena to Ms. Miller was only the most recent of a series issued to journalists in a politically sensitive inquiry that has on several occasions led investigators to question White House officials.

This is morphing into a freedom of the press debacle. YES they should tell who in the WH outed a covert agent for political gain- (and a frog marched Miller is a fun picture) but it just isn't going to stop there.

New precedent is going to end up being set regarding sources and with the executive branch evolving into a secret society that is classifying EVERYTHING, we will NEED leakers even more in the future.

6. Great discussion on KoJo's show today about why Novak has not been

subpoenoed. It's because they are asking all the background information so that when they finally get Novak under oath, they will be able to get him for perjury if he lies. They are laying all the foundations by questioning all the other journalists involved first.

18. Well, to be fair (ugh!), only eight of those may be ones actually told.

I'm sure that list isn't complete, and it's probably compiled from all the phone logs, investigations, and preliminary testimony. Russert apparently said he wasn't leaked to like Novak was. A good prosecutor would work toward such a list, probably ending up with Novak. They may even have a pared-down candidate list of who leaked. It may even be focused on one or two people. Now they're going closer and closer to get as much direct evidence as possible. It's one thing to have second-hand testimony ("I overheard so-and-so talking to such-and-such and heard the words 'wife' and 'Wilson'.") ... but it's far better to get 'so-and-so' on the record. All of 'em.

25. I think you're on the money with it being a phone list

Calls from WH, Air Force 1, Cheney's OEB office, etc.

It's also a top shelf phone list. When they tried to fry Wilson, or whatever they were doing, it was the big guns, major pubs. Wasn't it? (Think I read there were 8 actual outlets leaked to-- also seems to be a nat'l sec. 'beat' to the list here). They could have started and ended with Novakula and Moonie Times.

So my point, should I actually get to it, is that Judith was on the a-list; I think that's new info. Nothing gives these pricks more satisfaction than floating something in the librul NYT, something Miller has facilitated oh so many times.

Should add, maybe obviously but warrants thinking in case it's not, these aren't some mid-level functionary calls. Miller is their star as far as WH Communications dept. is concerned. The lowest contact she'd have is Scooter.


(And WTF is with "Scooter" anyway? Is this a prep school thing I missed or something? Innuendo of some sort?)

of WMD issues, and included the following paragraph -- I think it stands the test of time pretty well:

"And what of President Bush? Well, apparently he and the boys have been up to considerable mischief, including virtually gang raping one Judith Miller, deflowering her journalistic virtue, leaving her naked, and covered in dust, camel dung in her hair, casually abandoned out behind the Met Alpha mess tent. He's stringing out the subpoenas one at a time, rather than batching them like any other criminal investigation. And in each case he knows the "journalist" will file a motion to quash...which will take six weeks to sort out.

He's honest enough to issue subpoenas to the right people...
but corrupt enough to stonewall the case until after the election.

but a dedicated prosecutor who knows what he's doing. His strategy was to get the court ruling backing him up BEFORE subpoenaing the journalists with the most to reveal, such as Miller, Walter Pincus, etc.

34. How can a government official doing the job we pay them to do (talking...

...to the press) be a confidential source?

Even if that employee tells the reporter the information is not for attribution (or whatever), how can you say that a person sitting at a desk the taxpayers paid for, talking on a phone for which the taxpayers are paying the long distance bill, doing a job for which that person draws a check from the public treasury is acting in a confidential capacity?

These government people are not whitleblowers and their not private parties, acting in the capacity of private citizens. They're doing their jobs.

I do not understand how you can have a confidential relationship with a public employee acting in their capacity as a public employee.
