CBS News Exclusive: Bush Retains Personal Attorney In Plame Probe

This story says bush has merely consulted not retained. Still it's not that big a distinction in my mind at least.

edit again: MSNBC just said Bush has put a lawyer on "stand-by." That sounds like the same as "on retainer" to me.

but Albert Gonzales has his own little problems - like writing memos advising * to ignore the Geneva Convention forbidding torture. Plus, he may also be involved in this and is remembering the old maxim - a lawyer who defends himself has a fool for a client.

155. No attorney client privilege with WH lawyer
SCOTUS decided that during Clinton attempted coup. Theory is that since the government pays the lawyer, then there is no privilege to te president who talks to him.

Bad legal precedent for a lot of reasons, but now he's gotta have a private lawyer.

Lovin every minute of it.

,...I oughta' know,...I was a general counsel, once upon a time. And, I was the one who ended up consulting an ethics attorney.

Bush's WH counsel better be doing some consulting, as well. He's up to his ass in actually participating in criminal conduct (e.g. "how to creatively violate the Geneva Convention"). He may end up being one of the first to fall with his memo having been smeared all over the place.

Thanks to Ken Starr, Bush needs a private lawyer to have attorney-client privilege. Even corporate executives have to retain their own attorneys rather than depend on the corporate lawyers if they want to have attorney-client privilege.

We got to thank Ken Starr for this erosion in our liberties.

I suspect that Bush knows who the leaker his, someone whose initials are KR, and that he was given the info about Valerie Plame from someone with access to CIA information. Shall we say Dick Cheney and Scooter Libby?

Somebody is going to jail!

In this case, it all goes straight to the top, either actively or passively. If he did not actually, specifically, give directives and discuss or receive information (detailed or not), he set the tone for all of this. His reckless, damn-the-torpedoes, my-way-or-the-highway attitude that made clear to everyone around him "I want this and I'm gonna have it, by hook or by crook, and YOU'RE gonna get it for me. Whatever it takes" had permeated this entire regime. HE SET THE TONE AND DETERMINED THE AGENDA. Whoever is around him clearly knew what he was about and what he wanted and expected, the spoiled little dauphin that he is.

FURTHERMORE (and this MUST be remembered, and mentioned to anybody who says there's no difference between bush and Kerry), it's the people around him - MAINLY BECAUSE HE BROUGHT THEM IN WITH HIM. They wouldn't be working in the White House, the Old Executive Office Building, the Pentagon, the Justice Department, Foggy Bottom, or any of the cabinet offices, IF HE HAD NOT APPOINTED THEM OR OTHERWISE INSTALLED THEM THERE. If people want to blather away about how it's not him, it's the people around him who are causing all the trouble, it must be pointed out that those very same people around him are there BECAUSE HE BROUGHT THEM IN, AND PUT THEM THERE. They're all there BECAUSE OF HIM.

Just ask yourself, or ask any whiner who tries to foist off the blame on some lower-level henchman, would President Gore have chosen rummy for a Defense Secretary? Or a wolfowitz for Deputy Defense Secretary? Or a dick cheney as VP? Would dougie feith, scooter libby, richard luti, richard armitage, contradicta, richard perle or any of the rest of these bastards been enlisted for a Gore Administration?

At this year's National Lawyers Convention, the Professional Responsibility Group hosted a lively discussion on th question, "Who does the government lawyer represent?". The first panelist, the Honorable C. Boyden Gray, former White House Counsel under President Bush, discussed In re Grand Jury Subpoena Duces Tecum, 112 F.3d 910 (8th Cir.), cert. denied, 117 S. Ct. 2482 (1997), in which the Eighth Circuit held that the confidentiality of Mrs. Clinton's communications with government lawyers concerning the Whitewater investigation was not protected by the attorney-client privilege. The government lawyers' only client is the federal agency that they represent, including persons acting in their official capacity with respect to that agency. In In re Grand Jury, the government lawyers' discussions with Mrs. Clinton regarding nonofficial conduct constituted discussions with a person other than the government lawyers' "client," and thus, the discussions were not privileged.

Mr. Gray suggested that government officials should retain private lawyers for private matters and government lawyers for official matters. He stated that the taxpayer should not be forced to pay for a government lawyer who provides legal services to a government official on a private matter.


Mr. Gray explained that investigations of an official's conduct that took place prior to that official entered office are generally private matters and should be handled by a private lawyer. When a government official is being investigated on a matter that encompasses both private and official conduct, Mr. Gray opined that government lawyers may provide supervisory services, but should require private lawyers to render services for those matters that are more private than official in nature.

Valarie Plame, who worked on classified WMD surveillance overseas. Because Wilson didn't agree with Bush's* lies about Iraq's WMDs, the WH retaliated against him by "outing" his wife to conservative journalist Bob Novak. This outing not only endangered many CIA operations and Plame's life, but it is also an act of treason against the US.

The unmasking of Valerie Plame sheds light on the shadowy world of NOCs, spies with nonofficial cover


<snip>Some Bush partisans have suggested that the outing of Plame is no big deal, that she was "just an analyst" or maybe, as a G.O.P. Congressman told CNN, "a glorified secretary." But the facts tell otherwise. Plame was, for starters, a former NOC — that is, a spy with nonofficial cover who worked overseas as a private individual with no apparent connection to the U.S. government. NOCs are among the government's most closely guarded secrets, because they often work for real or fictive private companies overseas and are set loose to spy solo. NOCs are harder to train, more expensive to place and can remain undercover longer than conventional spooks. They can also go places and see people whom those under official cover cannot. They are in some ways the most vulnerable of all clandestine officers, since they have no claim to diplomatic immunity if they get caught.

Plame worked as a spy internationally in more than one role. Fred Rustmann, a former CIA official who put in 24 years as a spymaster and was Plame's boss for a few years, says Plame worked under official cover in Europe in the early 1990s — say, as a U.S. embassy attache — before switching to nonofficial cover a few years later. Mostly Plame posed as a business analyst or a student in what Rustmann describes as a "nice European city." Plame was never a so-called deep-cover NOC, he said, meaning the agency did not create a complex cover story about her education, background, job, personal life and even hobbies and habits that would stand up to intense scrutiny by foreign governments. "{NOCs} are on corporate rolls, and if anybody calls the corporation, the secretary says, 'Yeah, he works for us,'" says Rustmann. "The degree of backstopping to a NOC's cover is a very good indication of how deep that cover really is."

For decades, a varying number of NOCs (the exact figure is classified) have been installed abroad in big multinational corporations, small companies or bogus academic posts. The more genteel rules of traditional espionage do not apply to NOCs. When the Soviets caught a diplomat doing spy work during the cold war, they roughed him up a little and sent him home. Unmasked NOCs, on the other hand, have met with much harsher fates: CIA officer Hugh Redmond was caught in Shanghai in 1951 posing as an employee of a British import-export company and spent 19 years in a Chinese prison before dying there. In early 1995 the French rolled up five CIA officers, including a woman who had been working as a NOC under business cover for about five years. Although the NOC caught in Paris in 1995 was simply sent home, "it might not have been so easy in an Arab country," says a former CIA official familiar with the matter. "{NOCs} have no diplomatic status, so they can end up in slammers."

A NOC's ability to run silent and deep has led Ohio Republican Mike DeWine, a member of the Senate Intelligence Committee, to press the CIA to invest more heavily in NOC officers, adding that the CIA's traditional spies, posing as diplomats and trained to infiltrate governments, are not well positioned to penetrate stateless gangs of terrorists who don't go to embassy parties. DeWine called for a larger NOC program in a report issued by Congress in July — and many ex-spooks were surprised when the CIA cleared the document for public consumption. But the agency has resisted such efforts before, arguing that NOCs are too expensive and too dangerous to expand the program by much.

And here's how this went down. The case got all the way to the Supreme Court. US v. Nixon. The court ruled that there was such a thing as executive privilege but that the criminal case (the Watergate break-in) took precedence over executive privilege.

It would be tres interesting if we went the same route on that. 1) He doesn't have enough stooges on the Court to save him from this, imho. 2) it would be really hard to rule that this case was substantially different. In fact, outing a CIA agent is way more important than breaking into party headquarters.

IMHO, if he tries to stonewall this, he's history. I think he's history, anyway, but that would be the last 12 nails in the coffin.

On edit: wouldn't it be fun to watch Scalia try to spin this one for *?

184. I just figured it out.
Just saw an interview on CNN with a CBS correspondent who was held hostage during the last gulf war, tortured then transferred to Abu Ghraib (which he said was better than intelligence headquarters.) Can't think of his name right now but he does 60minutes2.
He said that one of the things that went through his mind when he saw the hooded photo was "so thats what it looks like from the outside." He also said that although the guards beat him to try to get information, he did not hold animosity toward the individual guards because he figured that orders came from Saddam and so was a systemic indicator. And he said with similar circumstances he figures the iraqis possibly also thought that the US soldiers did not do it on their own, but it was indicative of a bad US system.
I bet it is his personal experience that is keeping this whole thing alive on CBS.

48. Piece of Wisdom: Federal prosecutors do not like being shit on.
It's a personal trait needed for the job. Deep commitment to justice? Nice, but you don't need it. Compassion? Super, but you don't need it. Absoilute incapicity to stand people lying to you? Necessary. You can't do the job without that trait. So, we know the Federal prosecutor on the Plame case is a Republican, but that doesn't matter. The absolute inability to endure liars trumps all personal loyalties for a federal prosecutor. I think it is getting hot as hell, and the contempt and perjury charges will begin quite soon.

I also think, as I've said from the beginning, that Bush himself personally conspired with his politicos in the White House to expose Ms. Plame. Bush himself. He is a vindictive little shit, and I'd bet he's directly involved in this criminal activity.

When I first heard this story breaking, the first thing that came to mind was the revelation in Bob Woodward's book that Bush was often personally involved with Rove in political maneuvering (and dirty tricks in particular). His actions in retaining personal counsel at this stage bespeak his guilt, and his belief that the facts of his guilt are about to emerge.

This is very interesting news. Bush would not need a lawyer or make the announcement unless there is a reason. This probably means that Rove is being targeted and Bush is afraid that Rove may roll on him. I have been afraid that Bush would shut down the investigation by giving Rove a pardon. CNN reported a little while ago that apparently Chalabi told Iran that US had cracked their code. CNN then went on to say that secrets were told to Chalabi by a US official who was drunk at the time.

That doesn't mean he had too. As I recall, his initial testimony was in a civil case, which is even less compelling.

His testimony before the special prosecutor was VOLUNTARY:

On another note, I've been following the freeper threads on this. Man, are they sensitive! Somebody reported a newbie as a troll for posting the following:

Bush faces six problems before the election:
---the possibility of grand jury indictments against members of Cheney's office concerning the Plame leak.
---a probable investigation that Cheney "engineered" the Halliburton no-bid contracts.
---Michael Moore's movie due in late June and out on DVD before the election.
---Kitty Kelly's bio on the Bush family due in September.
---possible Supreme Court ruling ordering Cheney to open his energy task force files.
---possible continued meltdown in Iraq.

Let's say one of these explodes and impacts the public. I'm betting that two will.

If it was Rove, then he probably fessed up to the President after the shit strated hitting the fan. Meaning Bush knew and was a part of a potential obstruction effort. If it was Scooter Libby from the VP's office, Scooter would have fessed up to Cheney and Cheney to Bush. That implicates two in a potential obstruction effort.
