LA judge asked to drop California governor from case

LOS ANGELES (AP) - Gov. Arnold Schwarzenegger's attorney Tuesday asked a judge to throw out a libel lawsuit filed by a woman who, on the day before the recall election, went on TV and accused the action film star of groping her on a movie set.

The stuntwoman claims Schwarzenegger and his campaign intentionally defamed her after she alleged the Hollywood star lifted her shirt and groped her on film sets. Miller, 53, made the allegations on Oct. 6, the day before voters were to go the polls to decide whether to recall Gray Davis and to choose a replacement.

Hours later, Schwarzenegger campaign spokesman Sean Walsh sent an e-mail to reporters directing them to the Los Angeles Superior Court Web site, where there were records for a Rhonda Miller whose history included prostitution, drug crimes and disorderly conduct. She turned out to be a different Rhonda Miller.

The stuntwoman Rhonda Miller has no arrests or convictions for such crimes, her attorneys said.
In court, Miller attorney Paul Hoffman argued that there was a clear-cut case of malice by Schwarzenegger's campaign, meeting the constitutional conditions for the suit to proceed.
