Strauss-Kahn seeks dismissal of civil suit by maid
Source: Reuters

NEW YORK, Sept 26 (Reuters) - Former IMF chief Dominique Strauss-Kahn asked a judge on Monday to dismiss a civil suit filed by a hotel maid who accused him of sexual assault, saying he was immune from such a suit under international law when it was filed.

His lawyers filed a motion to dismiss the suit in a New York state court in the Bronx on Monday.

You're the one downthread lamenting that there no longer exists a presumption of innocence on DU, and here you are defending the lying "victim".

3. As opposed to a maid who lied on her asylum forms to get into
this country and said she was going after DSK for the money?

Gotcha.

Gotta love the lying lady.

I guess when you have consensual sex with someone that it's impossible to leave DNA behind?

28. How exactly is she a victim?
She lied about rape on her asylum app to get into the country and she was caught on tape saying she was going to take DSK's money.

22. Just so you know, she admitted to that, they never could've proved it.
She came from a hot zone which is why she got the asylum. It was neither provable or disprovable, but she admitted to it.

7. So, he didn't do it, but if he did do it he is above the law.

IF DSK didn't do it, why does he need immunity? No trust in the American legal system?.

9. never go before a jury
in a civil case, the only requirement is "a preponderance of evidence", which is basically 50.1% guilty. I'd be pulling every trick in the book to get a case against me dismissed no matter how innocent I was.

10. Why would he trust the American legal system after what he has gone through?
He would still be rotting in jail if he was an ordinary citizen because an ordinary citizen who was innocent could not afford the investigators an lawyers than are needed when you are framed. He would have to be certifiably insane to trust the legal system in a civil trial. In Europe civil actions are decided by judges. Here they are decided by juries and it is a crap-shoot on what the verdict might be.

Edited on Mon Sep-26-11 07:09 PM by KoKo
However...if you think about it..you might find a reason to think of how you would feel if you were in her shoes..against one of the most Powerful People in the World.

Ever think about that? Do you?

15. Most people had never heard of DSK so I don't think he was one
"of the most Powerful People in the World". But even so the service woman had a long history of lying. She lied to get in this country and she told a story to the prosecutors which turned out be lies. She used her bank out as a laundry for drug funds. DSK did not make her do any of these things. I have no sympathy for someone who tried to manipulate our legal system for her financial profit.

23. So wait, you say the American legal system is untrustworthy because a wealthy person gets off?
Edited on Tue Sep-27-11 05:19 AM by joshcryer
Are you sure you're saying what I think you're saying? That wealthy people represent the pinnacle of just law?

Fact is, if there's DNA, you go to fucking jail if a woman claims rape. Fact is, women have an impossible time running a rape trial and in the end cases get dropped. I have no problem with the former part of this, but the latter part is bullshit, with women being considered liars if they call rape. Yes some do lie, but I do not believe the liars represent the vast majority of cases.

I guess the Kobe Bryant case is "just law" because he was filthy rich he could do anything he wanted.

24. To compare one case with another is fatal in the legal system.
Everything defends on specific evidence and facts. DNA means nothing if sex is consental. A wealthy person has the resources to meet the vast resources of the state. An average person does not. That is a fact whether you want to admit it or not.
