Obama administration readies indefinite detention order for Guantanamo detainees
By Peter Finn and Anne E. Kornblut
Washington Post Staff Writers
Tuesday, December 21, 2010; 5:24 PM

The Obama administration is preparing an executive order that would formalize indefinite detention without trial for some detainees at the U.S. military prison at Guantanamo Bay, Cuba, but allow those detainees and their lawyers to challenge the basis for continued incarceration, U.S. officials said.

The administration has long signaled that the use of prolonged detention, preferably at a facility in the United States, was one element of its plan to close Guantanamo. An inter-agency task force found that 48 of the 174 detainees remaining at the facility would have to be held in what the administration calls prolonged detention.

<snipping>

However, almost every part of the administration's plan to close Guantanamo is on hold, and it could be crippled this week if Congress bans the transfer of detainees to the United States for trial and sets up steep hurdles to the repatriation or resettlement in third countries of other detainees.

Officials worked intensively on the executive order over the past several weeks, but a senior White House official said it had been in the works for more than a year. If Congress blocks the administration's ability to put detainees on trial or transfer them out of Guantanamo, the official said, the executive order could still be implemented....

Of course I'm being sarcastic. But just because an accomplishment doesn't directly affect you shouldn't mean it's less important.

57. Violation of the Rule of Law, Inernational Treaties, Committing War Crimes
directly affects all of us every minute of every day. Nobody has immunity, no one is innocent, and there's no right to trial by jury, confronting one's accusers, habeas corpus, and all those legal pieces of paper don't mean a blessed thing any longer.

A thousand years of progress, wiped out in one decision, constantly reinforced by the fascists and supported by....too many people who know better.

26. This has been posted here before, but bears repeating..."A Man For All Seasons"
http://www.answers.com/topic/man-for-all-seasons-a

Although it is the law that eventually forces <Sir Thomas> More's execution, the play also makes several powerful statements in support of the rule of law. At one point More's future son-in-law, Roper, urges him to arrest Richard Rich, whose perjury will eventually lead to More's execution. More answers that Rich has broken no law, "And go he should if he were the Devil himself until he broke the law!" Roper is appalled at the idea of granting the Devil the benefit of law, but More is adamant.

"What would you do? Cut a great road through the law to get after the Devil? ... And when the last law was down, and the Devil turned round on you - where would you hide, Roper, the laws all being flat? This country is planted thick with laws from coast to coast, Man's laws, not God's, and if you cut them down -- and you're just the man to do it -- do you really think you could stand upright in the winds that would blow then? Yes, I give the Devil benefit of law, for my own safety's sake!"

Too bad that President Constitutional Scholar doesn't get it.

The system is what it is.

Obama was never in a position to change anything. If he actually intended to change the way the machine operated he never would have made it outside of his home state.

The machine made that mistake once. They slammed the door hard in Dallas 1963.

53. "indefinite detention without trial"
> The Obama administration is preparing an executive order that would formalize
> indefinite detention without trial

Compare and contrast to the phrase "nor be deprived of life, liberty, or property,
without due process of law" in that document (well, one of the many) that is
apparently being regarded as outdated & irrelevent to the modern world.

"Most of the civilized nations of the world and human rights groups hold
unfavorable views of indefinite detention."
