ACLU Of Tennessee Calls On (Gov.) Bredesen To Veto Racial Profiling Legislation

The American Civil Liberties Union of Tennessee has sent a letter to Governor Bredesen, urging him to veto SB 1141/HB 670, in regards to Tennessee’s immigrants.

Officials said, "This legislation effectively requires individuals to carry immigration documentation at all times, so that they can prove they are in the country legally in case they are arrested. Sheriffs are required to send booking information to U.S. Immigration and Customs Enforcement for all people who cannot prove their legal status."

“SB 1141/HB 670 challenges the values of fairness and equality, invites disparate treatment of minority groups, and encourages racial profiling,” ACLU-TN Executive Director Hedy Weinberg said in her letter to Governor Bredesen. “This legislation is un-American and effectively creates a police state.”

According to ACLU-Tn.’s letter, “Using local law enforcement who are untrained in the complexities and proper enforcement of federal immigration law is a recipe for racial profiling.”

A legal analysis by the Maricopa County Attorney's Office asserts that Arizona's new immigration law will be difficult to enforce because it is based on outdated sections of federal law with very narrow legal parameters.

According to the wording of the new statute, its misdemeanors are charged if the defendant is in violation of certain federal statutes. Those federal statutes say the violator must be over 14 years old, that he or she has 30 days to register as an alien, and is in violation if willfully failing to carry registration documents.

According to the University of Arizona evaluation, the registration cards referenced in the U.S. Code are not currently used.
