San Francisco ChronicleState Sen. Roy Ashburn, R-Bakersfield, pleaded no contest to driving under the influence of alcohol this morning in Sacramento Superior Court.
Ashburn, 56, was arrested last month in downtown Sacramento and the arrest led to a firestorm about the senator's sexual orientation as he reportedly had been attending a Miss Gay Latina competition at a nearby club and had been seen frequently at the city's gay establishments.
... He did not appear in court today and made his plea through his attorney. Judge Russell L. Hom sentenced Ashburn to three years of informal probation and 48 hours in the county jail, though he was given credit for one day for the night of his arrest and will serve the remaining day on a work project.
... Ashburn is termed out of the Legislature this year, but will likely have several opportunities to vote on gay rights legislation in the coming months. In his radio interview, he defended his voting record and indicated he would continue to vote against gay rights legislation as that is what his constituents would have him do.
