Interracial Couple Denied Marriage License By Louisiana Judge

HAMMOND, La. — A Louisiana justice of the peace said he refused to issue a marriage license to an interracial couple out of concern for any children the couple might have. Keith Bardwell, justice of the peace in Tangipahoa Parish, says it is his experience that most interracial marriages do not last long. Neither Bardwell nor the couple immediately returned phone calls from The Associated Press. But Bardwell told the Daily Star of Hammond that he was not a racist. "I do ceremonies for black couples right here in my house," Bardwell said. "My main concern is for the children."

Bardwell said he has discussed the topic with blacks and whites, along with witnessing some interracial marriages. He came to the conclusion that most of black society does not readily accept offspring of such relationships, and neither does white society, he said. "I don't do interracial marriages because I don't want to put children in a situation they didn't bring on themselves," Bardwell said. "In my heart, I feel the children will later suffer." If he does an interracial marriage for one couple, he must do the same for all, he said. "I try to treat everyone equally," he said.

Thirty-year-old Beth Humphrey and 32-year-old Terence McKay, both of Hammond, say they will consult the U.S. Justice Department about filing a discrimination complaint. Humphrey told the newspaper she called Bardwell on Oct. 6 to inquire about getting a marriage license signed. She says Bardwell's wife told her that Bardwell will not sign marriage licenses for interracial couples.

"It is really astonishing and disappointing to see this come up in 2009," said American Civil Liberties Union of Louisiana attorney Katie Schwartzman. "The Supreme Court ruled as far back as 1963 that the government cannot tell people who they can and cannot marry."

on the basis of race. That would violate the 14th Amendment of the Consitution of the United States.

As to mixed marriage specifically, Loving v. Virginia covers it.

They're elected locally - I knew one who was a farmer - no training in law whatsoever.

11. Well, the Supreme Court....
...ruled in 1968 in Loving v. Virginia, that a state cannot discriminate against interracial couples who want to marry. And I'm certain that upholding the law and the Constitution is part of his oath of office.

...to consider. He can deny on the basis of age. He can deny if the person does not appear capable of giving informed consent. But basically, if they both have a pulse and they're of legal age, he's got no grounds to deny them a marriage license.

- And while that Napoleonic law down there in Louisiana is definitely different, it still doesn't trump the Supreme Court.

Divorce isn't about race, and President Obama, although no doubt affected by the loss of his father in his life, has obviously transcended the 'suffering' this bigoted judge claims as the basis for his denial of a marriage license.

Yup, those kind of people think they're doing us a favor by dare treating us like human beings. Ugh, and I hate when people bring up "I have black friends" as if that disproves racism. In fact, that one would bring that up is pretty questionable, at best.

I'm sorry that you've encountered those kind of people before. I haven't (or I don't remember having done so), and I hope you will never again!

The ACLU has been one of the leading organizations fighting for equal marriage rights for gay and lesbian couples for decades, they did not crawl out under a rock and I am sure the attorney was fully aware of that contradiction in the law when she mentioned it to the reporter.

134. Nope, JP is a pretty low level elected position here in Texas.
In the county where I worked they mostly handled traffic tickets and small claims court. Now that you mention it, it strikes me as odd that a JP would even issue a marriage license. That is done here at the county clerk's office. I guess things are different in Louisiana.

133. You are right about him being a justice of the Peace and not
a judge but I doubt he considers any union between races (married or not) to be of any value.

"Feel in my heart" is a legal argument? Next time I'm in court with a dead bang loser case, I'll just say that I feel in my heart that children will suffer if the court grants the defendant's motion.
