Defamation suit brought by man who made Obama YouTube video is dismissed (DU wins case)
Edited on Wed Feb-11-09 01:44 PM by Skinner
Source: Public Citizen

Public Citizen scored a victory today (2/10) when a federal judge dismissed a defamation suit brought by Minnesota resident Lawrence Sinclair against three people who criticized him anonymously on the Internet.

Public Citizen represents one of the three defendants and a blog that was subpoenaed to identify Public Citizen's client. The defamation suit was filed in the U.S. District Court for the District of Columbia.

Last year, during the presidential primaries, Sinclair posted a YouTube video in which he made outrageous claims against Barack Obama, arising from a supposed encounter at a Chicago nightclub in 1999 with the then-Illinois state senator.

In dismissing the suit, Judge John D. Bates found Sinclair's case did not show enough merit to identify the anonymous critics, who had posted about Sinclair on DemocraticUnderground.com and Digg.com.

"The right to speak freely and openly on matters of public importance - and to choose to do so anonymously - is a cherished right in this country," said Paul Alan Levy, the Public Citizen attorney who handled the case. "Courts have consistently ruled that there must be a compelling reason to take away someone's right to speak out anonymously on the Web. This case was no exception."

This case has been going on for about a year. Some of you may remember that Larry Sinclair had subpoenaed Democratic Underground to force us to disclose the identity of one of our members, mzmolly. We were determined to fight the subpoena, and were fortunate to receive free legal help from Paul Levy, an attorney at Public Citizen who specializes in Internet free-speech issues. (The press release is finally on the Public Citizen website. I have updated the link above.)

6. More Reich-wing insane hypocrisy: You post something on the internet BECAUSE
almost anything CAN be posted on the internet - and - then you claim somekind of right to limit, according to your OWN criteria that YOU define, how people are to react to what you have posted? . . .

That's just like the crazy RW emailers who claim a right to send stuff to you but get all crazy irate if you reply.

People like that are either hopelessly stupid or insane.

22. Snippets from the 3 part smackdown
The Court need not resolve here the precise standard appropriate for determining whether
disclosure of anonymous Internet speakers is warranted.

First, it is obvious that, as presented, the Court has no subject-matter jurisdiction over
Sinclair's complaint. He has alleged only state-law causes of action, and jurisdiction rests on
diversity of citizenship.
...

Second, there is likewise no basis to believe that Sinclair can establish personal
jurisdiction over defendants; certainly the complaint pleads no ground for personal jurisdiction
in the District of Columbia.
...

Third, for several reasons, the Court questions the sufficiency of Sinclair's claims in this
case. Of course, just stating that someone is "spreading lies" or is a liar may not be actionable as
defamation.

32. Congrats! And kudos to Ralph Nader for founding Public Citizen!
:applause:

http://en.wikipedia.org/wiki/Public_Citizen

Founded in 1971 by Ralph Nader and Alan Morrison,<1><2> its activities span a diverse range of issues, including energy policy, trade policy, campaign finance reform and accountability, consumer protection, medical malpractice, and public health.

The organization represents consumer interests in the United States Congress, the executive branch and the courts, fighting for openness and democratic accountability in government; for the right of consumers to seek justice in the courts; for clean, safe and sustainable energy sources; for social and economic justice in trade policies; for strong health, safety and environmental protections; and for safe, effective and affordable prescription drugs and health care.

Nader resigned as president of Public Citizen in 1980.<3> The organization currently is headed by Joan Claybrook, who was head of the National Highway Traffic Safety Administration (NHTSA) during the Carter administration, 1977 to 1981.

50. You guys always seem to piss off the weirdest amongst us...
I didn't know too much about the guy, but some blogs reveal quite a bit about both him and their own biases. Found this excerpt on one blog (http://lamecherry.blogspot.com/2008/08/political-prisoner-lawrence-sinclair.html) advertising dear Larry as a "political prisoner"...

"He was illegally detained like in a Turkish prison in DC, denied his medications like in a Russian gulag by US Marshals, lost in the system like in a Chinese prison in DC and has faced propaganda posted stories like a Nazi kangaroo court coming out of Delaware."

And this except is even better...

"The situation Mr. Sinclair has currently been placed in by the Democratic presidential ticket is they are forcing a disabled person with nerve damage to drive from Duluth, Minnesota to Delaware to be terrorized there in a court trial over a sealed indictment the Delaware Attorney General's Office will not respond to in direct violation of his Constitutional rights of Life, Liberty and the Pursuit of Happiness...."

You guys always seem to piss off the weirdest amongst us...

59. A classy set of lawyers you were up against:
Thereafter, in an Order issued on August 14, 2008, the Court denied Sinclair's motion seeking relief under 18 U.S.C. 3771 against the Department of Justice and directed that the Clerk accept no further filings from Sinclair's then counsel, Montgomery Blair Sibley, who had been suspended from the practice of law.

63. I want to thank Skinner for his support in this matter. I can't tell you all what
Edited on Wed Feb-11-09 01:31 PM by mzmolly
a comfort it was to know that he was willing to fight to protect the membership at Democratic Underground.

:toast: to all involved.

At the risk of sounding narcissistic ... ;) I'd also like to mention some of the internet justice seekers who offered their own brand of support.

THANKS TO THE FOLLOWING ~

First a shout out to http://hbeeinc.com/blog/">Hbee who attempted to inform me via DU that something was up.

The people at http://themitchandnanshow.wordpress.com/">The Mitch and Nan Show, now http://theregulator.net/">The Regulator who kept me informed and laughing through the stress.

The folks at http://deathby1000papercuts.blogspot.com/">Death By 1000 Papercuts who, in spite of their Conservative Politics took in interest in truth.

Of course Mr. Paul Levy who is brilliant and gave 1000% IMHO.

To an unnamed attorney who offered help in the beginning in spite of perhaps, not being legally bound to do so.

And, to my special new friends KS and J who, if they read DU will know who they are.

To TrueDelphi for allowing me to quiz her in a bizarre state of paranoia. :pals:

To MaddiesMom and others here who offered support.

And, last but not least, to my friend Liz who took a keen interest in my dilemma and supported me with cyber hugs and humor through it all.

______________________________________________________________________________________________________________________________________

Sorry for the poorly worded mumbo jumbo but I've felt the need to openly say "thanks" to many people for quite sometime.

And, to clarify, in spite of any claims to the contrary, I am not, nor have I ever been paid to type a danged thing on the internet.

One last note ~ To the other defendants, whoever you are, I hope that you are at peace today.

73. Thanks Starry Messenger.
I actually posted a Youtube video made by another person with a recap of the content. I was sued for passing along the claims of another party. Where the claims originated, who knows? But after observing scam artists in action for a while now, I have my suspicions. ;)

Sorry if that's cryptic but I have to be cautious going forward. *ehem*

Thank you so much once again for your efforts. The stress is indeed moving on. In fact, I enjoyed a toast of bubbly last night in celebration of the ruling. I felt that this chapter was the last to close before I could fully celebrate our new President.

I hope you'll stick around these parts? I'm certain that the rest of DU would also enjoy your gift with words and your sense of humor.

123. Thanks P2B.
I actually posted a counter video (produced by another defendant in the case) asserting that he was elsewhere during the original incident in question. The Judge ruled that the information posted was already on the internet, so essentially that's partly why there was not a sufficient case.

Hope that made a lick of sense?

I couldn't just sit and do nothing. I thought about you often and I am bursting with glee about this ruling. It was just chock full of smackdown. Long live free speech!!! (And thank you, Paul Levy)

109. Levy argued that
Edited on Wed Feb-11-09 03:37 PM by mzmolly
it was essentially not defamatory to claim that a person was NOT engaging in illegal, lascivious activity. The Judge appeared to agree. See page 7 of the ruling ~ http://www.citizen.org/documents/SinclairMemoOpp.pdf

"Indeed, the irony here is that defendants' alleged statements actually dispute whether Sinclair engaged in the criminal and disreputable acts that he has claimed, hardly the normal fare of a defamatory statement. The statement that Sinclair is a former mental patient, although perhaps defamatory, is most probably not actionable because mzmolly and OWNINGLIARS were simply summarizing and reporting information obtained from another content provider. See 47 U.S.C. 230(c)(1)."

The ACLU does such great work, caring & looking out for every-one's civil liberties that may be threatened or abused, the ACLU has done so for many, many years...

Also very happy there's been a comparatively new kid on the block, Public Citizen, supporting & looking after the Internet & free speech.

There's nothing the republicans want more than to control Internet content, just as the republicans own, control & dominate the media, (television & radio).

I think it worth noting that we can be grateful a Judge at the District Court level recognizes the rule of law to deny/dismiss.
Who knows what the USSC and its current make up would have ruled? My guess is less fairly.
Also, Joan Claybrook has stepped down (as of the end of January) as president of Public Citizen. Dr. Sidney Wolfe is serving as acting president. No matter who is finally picked to replace Claybrook it is going to be tough to fill the shoes of giants like Nader and her.

141. This attorney deserves big kudos here, please
some of them wouldn't waste their time on something of this nature, but this person went the full nine here IMHO

152. Democratic Underground defended by an organization started by Ralph Nader -- how deliciously ironic!

155. Not so sure Nader is at odds
with DU, but it is ironic that Nader helped me in a round about way.

I am grateful to him for his many good deeds. No comment on election 2000. ;)

163. A critial victory for the ENTIRE Internet -
This is consistent with past rulings and also has the wonderful quality of dismissing Sinclairs
fantasies, not to mention, affirming freedom right here and on Digg. Not a bad day's work.
Kudos to the lawyers and Judge.

Although I'm sure that you had few doubts that you'd come out on top against such an obviously deranged lunatic. :)
