CNNWASHINGTON (CNN) -- Prosecutors trying to persuade a judge not to throw out the criminal case against Sen. Ted Stevens expect the Justice Department to investigate them for their failure to disclose evidence that might help clear the 84-year-old GOP lawmaker.
On Sunday night, defense attorneys asked a judge to dismiss the criminal charges against the senator or declare a mistrial. They said prosecutors concealed information that would have helped them defend Stevens.
Sunday's court filing is the latest attempt by the defense to bring up such an allegation. The trial judge criticized prosecutors when the issue came up last week, but he allowed the trial to proceed.
The judge plans to rule by Monday night on the latest defense request for a mistrial or dismissal.
