Lawsuit Over Voter Registration Thrown Out

POSTED: 2:10 am EDT September 1, 2006
UPDATED: 3:26 pm EDT September 1, 2006

CLEVELAND -- A federal judge has thrown out Ohio's new rules governing voter registration drives, saying the regulations appear to be unconstitutional.

The lawsuit was filed in July by a coalition of groups. Judge Kathleen O'Malley ruled on Thursday that state Democratic lawmakers may join the challenge.

Secretary of State Ken Blackwell, Ohio's chief elections officer and the Republican candidate for governor, predicts the state will win the court challenge.

The lawsuit said criminal penalties for violating voter registration rules could deter people from canvassing.

14. The headline contradicts the story.
And it's so incompetent that it's probably not even an intentional lie.

confused when they can put out a positive headline for the right-wing. Also, if the right-wing had won, the article would have probably been more in depth, lasting more than four sentences.

It is as if these media outlets hire folks to write the headlines (almost always editors, not reporters) who cannot even understand the Democratic POV even when they have to write a headline about it.

Here's another story but not much better writing. IT'S A VICTORY FOR VOTER'S RIGHTS in Ohio and a defeat for Blackstabber. I think it follows another similar ruling in Florida within the last couple days.

11. I checked PACER for anything but NO ORDER posted in last three days
Edited on Fri Sep-01-06 03:42 PM by happyslug
I believe it is this case, but NO Order is listed, through an Affidavit was filed in the case on today (9/1/06). That is all that is on the Docket as of 4:35 PM, 9/1/06 (Plus 42 other exhibits since the case was filed):

1:06-cv-01628-KMO Project Vote et al v. Blackwell et al

This is filed in the United States District Court For the Northern District of Ohio.

And this is NO surprise, the case was filed in early July and today appears to have been the date for the hearing on granting the Injunction against listing LEGAL sanctions for anyone who sends in a voter registration cards with errors on the card.

CLEVELAND -- A federal judge threw out new state rules governing voter registration drives on Friday, saying they appear to violate the First Amendment and are hurting efforts to sign up new voters.

~snip~
The judge said that, in light of her ruling, voters should ignore the references to the criminal penalties on forms used to sign up new voters. She gave the secretary of state's office five days to remove references to the rules and penalties on its Web site.

13. How many people will read about how they should ignore what's on
Edited on Fri Sep-01-06 03:59 PM by SoCalDem
the forms? Probably not many.. and since there's probably no time to print new forms, the repubes have still won..

I can imagine someone reading that, and being afraid to continue..no matter how many times they are told to "ignore" that sentence...

Intimidation works..

The issue we should be ALL OVER is this..

why do we even HAVE to register? If we can prove we are a citizen, and are not a felon (they have those lists, y'know), we should be able to show up and VOTE..no registration needed..

As young men turn 18, they are AUTOMATICALLY issued a selective service number and are sent a form they MUST return.. Voting ID should be like that..

The govt KNOWS when every citizen turns 18, it's a No-Brainer..

IF people want to identify with a party, FINE..let them.. but people should never have to register specifically to vote.. It should be a natural part of turning 18, and when you show up to vote, all you should have to do is show proof of your current address..

16. Phase I of Disenfranchisement Project Complete. On to Phase II
Edited on Fri Sep-01-06 06:12 PM by Doremus
"Secretary of State Ken Blackwell, the Republican candidate for governor, plans to comply with the order and not challenge it, said Larry James, an attorney for Blackwell's office who was in court Friday."

Rat bastard isn't appealing because it wasn't necessarily his intent to try to make this rule of his stick. His MO is to make these convoluted regulations that derail everybody's registration programs and keep them busy with lawsuits instead. Remember 80# paper stock in 2004?

Phase II coming up. My bet is it involves the photo IDs required to vote. Something like "only state-issued IDs accepted," such edict issued only days before the election ...

Edited on Fri Sep-01-06 11:12 PM by pat_k
i.e., Upheld charges brought in lawsuit. . .

Looks like it's an ABC affliate, but that headline looked like something FOX would "accidently" do.
