Phil Inquirer: A bequest or a breach of trust?
snip

The branch manager and assistant manager at the Prudential Savings Bank at 19th Street and Snyder Avenue knew that DiCesare, a retired sign painter who lived alone and seemed to have no family, had nearly $700,000. They doted on him whenever he stopped into the bank.

In the summer of 2000, the bank managers helped DiCesare open a trust account. It named two beneficiaries - themselves - to receive all his money upon his death.

In court documents, Mazzei and Squitieri insist that DiCesare was of sound mind - and quite fond of both of them - when he bestowed his fortune. He had banked there for years and knew both women well. Both denied doing anything to take advantage of him.

1. They took advantage or a mentally addled old man.
One key reason: DiCesare's doctor had diagnosed him with dementia two years before he signed his name to the trust account that gave the women his money.

Witnesses at a trial before O'Keefe last November described DiCesare as a fearful and suspicious man whose behavior strongly suggested that he had lost his faculties. One woman testified that DiCesare told her people were "coming through his walls" to steal his money.
