WASHINGTON (AP) - If there is a Supreme Court vacancy this summer, President Bush may look no farther than the Capitol for a member of Congress who can be confirmed quickly. Past presidents have done it, more than two dozen times.


While admittedly long shots, GOP Sens. Jon Kyl of Arizona and John Cornyn of Texas are being talked up by some conservatives as possible nominees for the high court.

Seen as most likely to step down is Chief Justice William Rehnquist, who at 80 is fighting cancer. Retirement also might be attractive option for Justices Sandra Day O'Connor, 75, and John Paul Stevens, 85.

Kyl is a stalwart pro-business conservative and a senior member of the Senate Judiciary Committee. Cornyn is a former Texas Supreme Court justice and state attorney general. Both men have been at the forefront in fighting Democratic filibusters against Bush's federal appeals court nominees.

Sen. John Cornyn said yesterday that recent examples of courthouse violence may be linked to public anger over judges who make politically charged decisions without being held accountable.

In a Senate floor speech in which he sharply criticized a recent Supreme Court ruling on the death penalty, Cornyn (R-Tex.) -- a former Texas Supreme Court justice and member of the Judiciary Committee -- said Americans are growing increasingly frustrated by what he describes as activist jurists.

"It causes a lot of people, including me, great distress to see judges use the authority that they have been given to make raw political or ideological decisions," he said. Sometimes, he said, "the Supreme Court has taken on this role as a policymaker rather than an enforcer of political decisions made by elected representatives of the people."

The name I've heard bumbling around the Net for Chief Justice is a bit scary.

Ted Olson--Intelligent. Highly ideological. Evangelical. Fascistic.
If it's him we have to keep him off the court.

Thinking about him I can still see the face of that mealy-mouthed wife of his on CNN, MS-NBC, and all the other networks smiling while she spewed her dispicable lies. Well, she was on the 757 that crashed into the Pentagon. But remember Ted Olson when he argued for Bush in Bush v. Gore in front of SCOTUS. He is currently solicitor general at Justice and a prime candidate.

And between Kyl and Cornyn, I can't say which would be worst. They're both equally despicable, I think.

21. Exactly, the Senate is less likely to fight one of their own!!
Typical sneaky Bush to pick a Senator. But losing Rehnquist to a conservative is not as bad as losing O'Connor or Stevens to a conservative. Then we will have real trouble.

15. There won't be a big fight against Renquist's replacement
because he is one of "theirs." If Stevens (seen as a liberal justice) or O'Conner (seen as a moderate) retires, there will be a fight over the replacement because that would "tip the balance" of the court.

16. Typical political ploy
but usually they prefer a non name recognition judge. The GOP Senators come on board once several names are actually suggested like this and they have to face they DON'T want one of their own up there but a more circumspect tool. If not me, then no one quells the secret wishes of those with the power to vote.

Of course don't look to the Senate to play hardball with this president who might appoint the Bob Jones legal counsel to Chief Justice out of spite.
