Schiavos parents say no more Federal appeals
Florida state court to rule on latest challenge today

NBC, MSNBC and news services
Updated: 10:20 a.m. ET March 26, 2005

PINELLAS PARK, Fla. - The attorney for Terri Schiavos parents, David Gibbs III, said that he will make yet another state court appeal if he loses this petition, NBCs Mark Potter reported on Saturday.

However, Gibbs will not appeal the latest U.S. court loss.

"The Federal Courts have ruled that the law passed by Congress is a nullity. There are no claims that could be brought forward for Terri, with how the courts have construed the law, the attorney said.

After the federal appeals court panel rebuffed them yet again, Schiavos parents made another desperate attempt to keep their brain-damaged daughter alive, telling a judge that she tried to say I want to live just minutes before her feeding tube was removed a week ago.

Pinellas Circuit Judge George Greer was expected to announce a decision by noon Saturday on the motion by Bob and Mary Schindler claiming their daughter said AHHHHH and WAAAAAAA when asked to repeat the phrase I want to live.

The appeal is seen as a long shot because Greer was the judge who ordered Schiavos feeding tube removed March 18. Doctors have said Schiavos previous utterances were involuntary moans consistent with someone in a vegetative state.

1. Anything can sound like anything if you want it to badly enough.
I remember when I was in grade school, and this group of religious types got on the local hard rock station to "show" how heavy metal records had messages in them hidden in reverse by Satan.

3. It ought to be easier for her to talk without it then.
There is no doubt in my mind that if Terri were to say, "Give me some fucking pie," people would jump through their asses to hook her up.

9. The feeding tube was in her belly
Not through her mouth.

I find it shocking that her parents actually believe any of this. She tried to talk??? It's time to say good-bye, as painful as that is.

I wish them all peace.

"Ahhhhhh Wahhhhh"????

In all seriousness, how do we know that she didn't mean to say "I want to die!" Heaven knows I would if I was in her condition.

Besides, she has been saying "ahhhh wahhhh" for 15 years and I doubt her vocab has expanded much.

18. It seems to me that if Terri could "talk" doctors and judges would have
been called in to actually witness for themselves, with their OWN eyes and ears what she said. Instead, once again, her parents are making a claim, they didn't bother to have a witness verify!

When I went through this, my relative was able to "communicate" for a VERY short period of time before her brain shut down. She was paralyzed on one entire side of her body, but her efforts at "communication" where OBVIOUS to everyone involved, including her doctors. If asked a question with a yes or no answer it was fairly easy to see what her answer was. Her doctors did not give up trying to communicate with her in any way until it was clear she could no longer communicate! they then gave the family EVERY opportunity to decide whether we wanted to keep her alive in the state she was in or let her go. They were really very sympathetic and very honest about what was going to happen with her. They even discussed the fact that "miracles" do sometimes happen. Anyone that thinks Terri's doctors haven't discussed EVERY possibility with this family is EXTREMELY naive. Believe me, her doctors have gone out of their way to explain everything to these parents. They are just as human as you or me and they do have emotions. They do everything they can to help family members grieve.

Terri's has been unable to "communicate" in ANY way that those involved have been able to discern from day one! It is really very sad to me that Terri's parents can't see for themselves the TRUTH of Terri's existence.

27. Schiavo Feeding Tube Plea Heads to Supreme Court
As Terri Schiavo drew closer to death Saturday, a Florida state judge rejected another attempt by the brain-damaged womans parents to reconnect her feeding tube, leaving the couple with little hope they could keep her alive.

Her parents, Bob and Mary Schindler, planned to appeal the ruling to the state Supreme Court later today, family spokesman Gary McCollough said. The high court last week refused to intervene for the Schindlers. Pinellas Circuit Judge George Greer rejected the parents argument that Schiavo tried to say I want to live before her tube was removed March 18. They argued that she said AHHHHH and WAAAAAAA when asked to repeat the phrase.

Eight people were arrested outside her hospice yesterday for trying to take her water, but on today, Bob Schindler asked one of the protest leaders to end any efforts to get people arrested. Please tell your people here, do not make any scenes, Schindler told the man.

29. The FATHER says "do not make any scenes"???
Oh, yes, we wouldn't want any "scenes" made...cuz the family has kept this has been such an uneventful, private family matter for the past month, right?? It's a shame these "scenes" came along and destroyed that.
Someone tell this guy if he is going to hide behind the fundies then he gets everything that comes WITH them...

32. I think the federal courts may have sent the message
that they're likely to invoke Rule 11 on any further filings.

I suspect the threat of sanctions had something to do with why the attorneys have decided to leave well enough alone on that front....

33. LTTE: Overlooking the Key Issue in the Shiavo Case
Just sent this.

Letters to the Editor
The New York Times

Dear Editor:

A primary purpose of the law is to establish uniform standards as to the spending of public funds. The cost of Ms. Shiavos life support is now being covered by Medicare, Medicaid and publicly funded hospice resources.

Citizens have no obligation to fund artificial life support indefinitely. The law correctly presumes a person in Ms. Shiavos situation is beyond reasonable hope of recovery.

Those who believe otherwise rely upon their faith for guidance.

The purpose of the law must not be to infringe upon the rights of others to sustain a faith-based hope at their own expense. Those who believe in the possibility Ms. Shiavo is in fact now sentient or may one day become so should be allowed to put their money where their faith is.

The law should permit continued life support for Ms. Shiavo so long as the cost is covered by private funds.
