Grand Jury Subpoena Stands for Time Magazine Reporter

Thursday, November 18, 2004; Page A06

A federal judge yesterday refused to quash a subpoena seeking the testimony of Time magazine reporter Matthew Cooper and ordered him to answer questions before a grand jury investigating whether Bush administration officials illegally leaked the identity of a CIA operative to the news media.

...

Cooper's lawyers said Fitzgerald's demand for a second chance to question Cooper was "unreasonable and oppressive." But U.S. District Chief Judge Thomas F. Hogan said the focus of Fitzgerald's investigation has shifted unexpectedly since that interview and he rightly seeks to ask other questions.

4. Can somebody tell me why Novak, who broke the story...
...hasn't been questioned by the grand jury? It seems like they've questioned every other journalist on the east coast but it's like Novak has a magical get-out-of-jail card.

Just puzzled.

...the trap for when Novak has to testify in court. If he waffles, then they can get him on perjury as per other's testimony.

Novak is not going anywhere. Having everyone else's version first is much better to set him up

10. Perhaps he's a subject of the investigation
I don't know how but who knows what's been uncovered about his relationship with the WH.

22. A subject, but not THE subject
They're after the leaker, not the one(s) who reported it. However, those who reported it, I'm sure, know exactly who itwas that gave them the information.

There are few people who actually have legal access to the "who" part of our CIA agents. And for very good reason.

13. Well, he can't speak about the case...
Sometime last spring I saw him on a C-SPAN morning show and he said, in response to a question from a viewer, that he was legally barred from responding to the question...

8. "shifted unexpectedly" preceded, or followed, Rove appearance?

Cooper testified in August; Rove went before the grand jury in late October. The judge's reference to the probe having "shifted unexpectedly" makes no specific time reference. Did Rove lay himself a trap in which Cooper can now toss him?

14. Wow! Cool.
"Shifted unexpectedly"? Sounds dramatic. I mean, if it "shifted unexpectedly" into a dead end, it seems unlikely the judge would have granted the interview.

Keep hope alive!

18. I'm sitting here reading all these threads and a thought occurs to me
What is the position of the new Attorney General on this case? Has he ever said anything about it at all?

Maybe he thinks punishing people for the crime against Plame is "quaint"?

20. Sharp. Good question. "Quaint". All kinds of new definitions and faces
gaining new positions of power??? Yep, it is "quaint", alright, and really, frighteningly questionable.

19. Is this the beginning of a "finally, finally" moment in time?
It is just almost too much to hope for. Oh, please.

Just why did it have to take so long and why did we have to wait until after the "selection".

Why?

21. Actually if it really happens, it will be more disgraceful for Bush
Co. to be in office. If it does happen, and I am doubtful, I hope this country finally turns on the little weasel like the rest of the entire world has done. I hope he has to sell his beautiful ranch just to pay his lawyer's fees. Hope, Hope, Hope.
