Wednesday 12/29 Election/Fraud/Recount thread
In order to organize and document I thought it would be a good idea to have a daily thread to place items related to the recounts/fraud. This also make it easier to "catch up" when we are away from the computer for a while.

Please help us. If you see something that isn't here post it with a link to the thread and a thanks to the author. Thanks to everyone who is helping in this project.

"HD: I think we need to focus on election officials. County Clerks, Secretaries of State in particular, because the Republicans have been so partisan in exercising their responsibility to help people vote, theyve in fact tried to suppress turnout instead of encourage it. Secondly, we, I think we need to try to get laws passed, by referendum if necessary, that says that no voting machines in a particular state or jurisdiction may be used unless they can be recounted by hand. Oregon has such a statute because Bill Bradbury (Oregons Secretary of State) got one passed in 2001. We should try to state by state overhaul the election process both by referendum and by electing where possible Democratic Secretaries of State and County Clerks."

Dean always was ahead of the curve on recognizing election fraud as a real and present danger. His locally based strategy is right on, and indeed the only way available to us now that all three branches of the Federal Government are under Republican control. Of course, it also needs the movement charisma of people like Martin Luther King or Jesse Jackson, a whole Woodstock's worth of powerful groovy counter-culture and so on.

I imagine the working folks will have a chance to read this now. I know it is probably difficult to call during working hours, but if there are any of you out there that can, please do.

Spead the word. Ask Ohio AG why they will not enforce the law. Is it truth that they stated putting Katherine Blackwell under oath is harrassment?
I tried to locate an 800 number, but there was only one for consumer protection. If anyone knows of an 800 number for Ohio AG please post.

TOLEDO, Ohio -- Election officials finished the presidential recount in Ohio on Tuesday, with the final tally shaving about 300 votes off President Bush's six-figure margin of victory in the state that gave him a second term.

The recount shows Bush winning Ohio by 118,457 votes over John Kerry, according to unofficial results. Ohio and its 20 electoral votes tipped the race to Bush.

The Kerry campaign supported the recount, but said it did not expect the tally to change the election winner.

A group of voters citing fraud have challenged the election results with the Ohio Supreme Court. The voters, supported by the Rev. Jesse Jackson, have cited irregularities including long lines, a shortage of voting machines in minority precincts and problems with computer equipment.

Maybe we'll finally stop getting those "Why aren't you covering this?" emails:

Election officials finished the presidential recount in Ohio on Tuesday, with the final tally shaving about 300 votes off President Bush's six-figure margin of victory in the state that gave him a second term.

The recount shows Bush winning Ohio by 118,457 votes over John Kerry, according to unofficial results provided to The Associated Press by the 88 counties. Lucas County, home to Toledo, was the last to finish counting.

Of course, now we have to deal with "They stole the recount!" form letters and maps showing how the counties that went to Bush were former "slave counties"....

We lost, everybody. L-O-S-T. Just concentrate on your Canadian visa applications; if you screw that up, you can't blame Deibold.

(CNSNews.com) - The good news for Democrats, who still believe that President George Bush may have won the state of Ohio on Nov. 2 as a result of fraud, John Kerry picked up about 300 more votes in the state's presidential recount. The bad news for those Democrats: Kerry still lost the state to Bush by 118, 457 votes.

The Kerry campaign supported the recount that was formally requested by two fringe candidates, but the Democratic nominee long ago conceded the Ohio results, which were essential to Bush winning a second term.

On top of netting the extra 285 votes from the state procedure, Kerry gained about three dozen more when some of Ohio's counties changed their certified vote tallies.

"The intention was always to verify whether there were anomalies in the voting process," said Libertarian candidate Michael Badnarik. "The purpose of the recount was not to change the outcome."

The election is long over. A new year is starting, and even most of the more ardent liberals are moving on. But in Louisburg Square this week, one determined group isn't quite ready to let go. About a half dozen supporters of John Kerry are holding vigil in front of his house, still hoping for a Kerry presidency.

The little knot of demonstrators, calling themselves the Coalition Against Election Fraud, stood shivering in the cold yesterday, hoisting signs and pressing fliers into the hands of bewildered passersby. Taxi drivers, neighbors digging cars out of the snow, and Beacon Hill residents who happened to be strolling by were subjected to earnest pleas to join the cause.

''Who knows? Maybe we'll overturn the election," said Sheila Parks, a vigil organizer.

Parks said the group believes the election was fixed and wants to persuade the Massachusetts senator to oppose congressional approval of the electoral college results Jan. 6. That would set in motion the process of questioning George W. Bush's victory in November. Such a challenge has never been successful, and nobody in Washington expects one now.

Politics is a game played by rules. And the most important rule regarding close elections is that you don't win by being conciliatory during the recount process. Indeed, the only way a candidate who trails on election night ends up taking the oath of office is by refusing to concede and then confidently demanding that every vote be counted -- even when the opposition, the media and the courts turn against you.

That is a rule that Al Gore failed to follow to its logical conclusion in 2000, and that John Kerry did not even attempt to apply this year. Both men were so determined to maintain their long-term political viability that they refused to fight like hell to assure that the votes of their supporters were counted. That refusal let their backers down. It also guaranteed that, despite convincing evidence that the Democrat won in 2000, and serious questions about the voting and recount processes in the critical state of Ohio in 2004, George W. Bush would waltz into the White House.

Maybe someday, if the Democrats really want to win the presidency, they will nominate someone like Christine Gregoire. Gregoire is the Washington state attorney general who this year was nominated by Democrats to run for governor of that state. She is hardly a perfect politician -- like too many Democrats, she is more of a manager than a visionary; and she is as ideologically drab as Gore or Kerry.

But Gregoire had one thing going for her, and that was her determination to win.

The fight may not be over yet. Rossi is crying foul. But the likelihood is that, in Washington state, the Democrat, not the Republican, will be taking the oath of office in January. There are two reasons why this is the case. First, Christine Gregoire got more votes. Second, she demanded that they be counted.

COLUMBUS, Ohio - Chief Justice Thomas Moyer of the Ohio Supreme Court on Wednesday refused to remove himself from a case challenging the results of the presidential election.

Moyer also rejected a request by voters challenging the results for a speedy hearing and an order that election boards preserve evidence from the election.

Moyer said there is no reason for him to remove himself since the challenge doesn't involve his own election and he has nothing to gain by a change in the results.

Citing fraud, 37 voters backed by Columbus attorneys Cliff Arnebeck and Bob Fitrakis have challenged the results of the presidential race in Ohio. They point to long lines, a shortage of voting machines in predominantly minority neighborhoods and problems with computer equipment.

The Worst FOX Segment Yet


That's saying a lot, I know. Was it Bill O'Reilly or Sean Hannity? No, it was Alan Colmes yelling at someone named David Lytel for 45 minutes for reasons I never quite figured out.

Apparently, Lytel has a website called www.redefeatbush.com which is organizing a protest of the Ohio electoral vote outcome on January 6. For some reason, this infuriates Colmes because, he said, it makes Democrats look like sore losers. Colmes was also insulted by remarks made about him on Lytel's website.

Ordinarily, I would re-listen to my tape of this segment, then try to recap and analyze what each side had to say. But, frankly, it was so upsetting to me, I can't stand to hear it again. Colmes started off the interview angrily accusing Lytel of having a bad attitude and it went downhill from there. I hardly got a clue about what Lytel was trying to say because Colmes kept interrupting him and shouting at him and then shouting more that Lytel hadn't answered the question. When the segment was over, I was literally shaking in my chair.

Putting aside my personal discomfort, the real shame of it, in my view, is that this important and interesting issue never got discussed. As I wrote in a comment to Deborah's post about Lytel's appearance on Hannity & Colmes last week where, apparently, Lytel was also attacked, I don't know where I stand on the issue of voter fraud in Ohio and what should be done. But the subject deserves a thorough and fair airing and Colmes' hostility to doing so puzzles and dismays me. In fact, I have heard the topic discussed fairly on Colmes' show (with Greg Palast) so what Colmes' problem with Lytel was, I simply don't get. Is it the protest Colmes hates? The fact that Lytel insulted him? Whatever Colmes' reasons, what could be more important to our democracy than the question of whether or not the person in the White House was fairly elected? Don't tell me it doesn't deserve the same amount of open-minded consideration as putting the Christ back in Christmas.

WASHINGTON (NNPA) The patchwork of local and state voting laws should be replaced with a single federal standard that would make it easier to detect and reduce voter fraud, community leaders say.

It has been almost impossible to monitor the voting process the way the system is set up. People were turned away from polls, electronic machines didnt carry the vote as people wanted it to be carried and numbers didnt meet the reality of the number of voters that came out, said Congresswoman Sheila Jackson Lee (D-TX.). This is not about Kerry or Bush. Its about the birthright of Americans to vote a constitutional right.

Lees remarks were made at a hearing on Capitol Hill called by Congressman John Conyers Jr. (D-Mich.). The hearing was held last week to look to allegations of voter fraud in Ohio, a battleground state that determined the eventual winner.

We have to find out where the fraud and misconduct has taken place and who did it, so we know how to repair it. Were in phase one. Finding out what went wrong and where our laws need to be built up, said Conyers. One of the things that have come up is the need for one piece of equipment for every state.

OLYMPIA Democrat Christine Gregoire, the three-term state attorney general who fought America's tobacco industry, Internet porn and schoolyard bullying, becomes Washington's governor-elect Thursday, by a scant 129 votes out of more than 2.8 million cast.

But a legal challenge could be right around the corner, perpetuating the longest, closest governor's race in state history. Her Republican rival, Dino Rossi, isn't conceding yet.

``No concession,'' said Rossi spokeswoman Mary Lane. ``There are just too many questions, too many problems. As of right now, we don't believe this has been a proper or well-run election.''

Senator Byrd got many visits today and I think he is 1 of the Senators who will come through for us. Please try to call him at the 1-800-839-5276 but if his office is closed then fax him at 1-202-228-0002, make sure you add why the major media is blocking this story! Byrd is an older guy, as we all know, he may still be deluded about the independence of the press in America. I can tell because his aide, Ms. Barth has asked for faxed copies of real news articles on the fraud from the major press, especially the NYT and the Wash Post. She does not want electronic copies, if you have any laying around please fax them to her at 304-343-7144 and then fax a letter to the other number above, try to keep it to 2 pages or less!!!

With so much current focus on the outrageous fraud perpetrated by Republicans in Ohio relative to the 2004 presidential election, including the current move on the part of Secretary of State Kenneth Blackwell in eluding the issuance of a subpoena, it is important also to direct attention to the popular vote.

A recent study revealed that, after tabulating exit poll forecasts on the presidential popular vote, the median result was Kerry 51% and Bush 48%. This is the reverse of the figures proclaimed to be official, embodying a substantial 3-percent shift. Once again we are being asked to believe that the exit polls badly misfired just as they did in tabulating anticipated state results.

It is interesting to note that Dick Morris conceded that the current testing mechanisms are so advanced that discrepancies of the kind the corporate media asks us to swallow are inconceivable. Morris cites instead a Kerry campaign scheme that skewed the exit poll results. Remember the difference between a good conspiracy and a bad conspiracy. Certain media hypocrites who denounced any scrutiny of the 2004 voting results by progressives have no trouble embracing Morris. Progressives are accordingly labeled spreadsheet conspiracy theorists.

The logical question to ask would be this: Would Karl Rove engage in a one-step or two-step strategy? A Rove one-step ploy would involve trampling the voting process in a few states to secure victories in Ohio and Florida, which would deliver game, set, and match to his candidate. After the verbal pummeling Rove and company received four years ago after Bush trailed Al Gore by better than 500,000 votes in the popular category it would be foolhardy, if the system were to be tampered with at all, to fail to rectify a situation that could result in the Republican candidate chosen initially by a one-vote Supreme Court majority losing the popular vote for the second election in succession.

The Montana Supreme Court resolved an election dispute for a state House race after the first count showed the people's vote tied. The court tossed out "one or more" disputed ballots, giving the Democrat the win. This resulted in a 50-50 party tie in the Legislature. Under state law, that will give control of the Legislature to the Democrats. (The House member promises to introduce a bill requiring hand recounts next time.)

Yesterday the North Carolina Board of Elections ordered a new statewide election for the hotly contested agriculture commissioner race. This came about because one county's voting machine eliminated 4,438 votes when the difference between the winning candidate and the challenger was only 2,287 votes.

The list goes on: Ohio's presidential recount is complete, but questions continue about the role of a partisan secretary of state. That election is under litigation, too. But the secretary -- backed by a state attorney -- has refused to testify about how the election was run.

I have seldom seen tears come to his eyes.

But there was Rev. Jesse Jackson, Sr., sitting in front of Detroit Rep. John Conyers, expressing his pain at the indignity of having to fight to legitimize the right to vote all over again, urging the Congressional Black Caucus to go to Ohio and hold hearings on the massive evidence coming out of voter disenfranchisement coming out of that state.

To his credit, Rep. Conyers not only responded, but was somewhat ahead of Jackson by calling the hearing in the first place. And he also committed himself and the CBC to going to Ohio and other places to continue the fact-finding role they were pursuing.

The hearing was packed with individuals, many of whom had important information on the degree of voter disenfranchisement. They told of results in the voting data in some counties that did not could not -- have been reconciled with the initial exit polls. They told of voter purges in the Cleveland area that accounted for the mystery that Cyuhoga County, where Cleveland, is located had no more people registered in 2004 than in 2000, while Franklin County where Columbus is located, had far more people registered this time than in 2000.

Well, they fooled us once, shame on them, and now they have fooled us again, shame on us. Shame on us for believing that all of this is accidental. Shame on us for allowing the people we vote for to turn their back and walk away from challenging the system to count our votes. Shame on us for not mounting a means to protest loudly what has happened in our name and most importantly in the name of Democracy. Shame on us for allowing the massive double-standard to exist, where the American president stands before the world and criticizing the result of elections in the Ukraine, when his own house is filthy. And just shame on us for having the audacity to call people out to vote and then allow the system to corrupt the innocence faith they have invested in the political system to work in a fair and unbiased manner

Republican Dino Rossi on Wednesday urged his Democratic rival in the closest governor's race in state history to join him in calling for a revote.

"The uncertainty surrounding this election process isn't just bad for you and me -- it is bad for the entire state," Rossi said, reading from a letter he said he sent to Democrat Christine Gregoire. "People need to know for sure that the next governor actually won the election."

The election is long over. A new year is starting, and even most of the more ardent liberals are moving on. But in Louisburg Square this week, one determined group isn't quite ready to let go. About a half dozen supporters of John Kerry are holding vigil in front of his house, still hoping for a Kerry presidency.

The little knot of demonstrators, calling themselves the Coalition Against Election Fraud, stood shivering in the cold yesterday, hoisting signs and pressing fliers into the hands of bewildered passersby. Taxi drivers, neighbors digging cars out of the snow, and Beacon Hill residents who happened to be strolling by were subjected to earnest pleas to join the cause.


''Who knows? Maybe we'll overturn the election," said Sheila Parks, a vigil organizer.

Parks said the group believes the election was fixed and wants to persuade the Massachusetts senator to oppose congressional approval of the electoral college results Jan. 6. That would set in motion the process of questioning George W. Bush's victory in November. Such a challenge has never been successful, and nobody in Washington expects one now.

Here is the text of Republican Dino Rossi's letter to Democrat Christine Gregoire urging a new election for governor of Washington:

Dear Attorney General Gregoire:

The secretary of state will certify you as governor-elect tomorrow (Thursday). Although you will be certified, with all the problems that have plagued this process, there won't be many people in our state who believe with certainty that you actually won the election. The uncertainty surrounding this election process isn't just bad for you and me, it is bad for the entire state. People need to know for sure that the next governor actually won the election.

Additionally, I don't believe you'll find many people in this state who think the hand recount was more accurate than the first two counts. Even some Democratic elections officials have said hand counts are less accurate. So we're now in a situation where nobody really knows who won this election.

The law allows me to contest the election. An election contest would bring every questioned aspect of this election before the Legislature or a court for review. It would take many weeks, perhaps months, to complete. At the end, even if the results were to change back in my favor, the state would have suffered from the long, drawn-out process.

For several weeks, former Secretary of State Ralph Munro has argued that this election will never be seen as legitimate and that the best option is to put it back into the hands of the voters for a revote. If our roles were reversed, if you had won twice and I had only won in the less-accurate hand recount, I would support a revote. I would not want to enter office with so many people viewing my governorship as illegitimate.

County Panel Rebuffs GOP Bid ; Canvassing Board Says No to Counting Rejected Ballots


The Clark County canvassing board met Tuesday afternoon and became the 39th and final county to reject a long-shot bid by Republicans to shake loose more Dino Rossi votes before resorting to a lawsuit.


"That makes it unanimous," said assistant elections director John Pearson of the secretary of state's office, which urged counties to turn down a request by the Republican Party to count hundreds of rejected ballots, including 24 in Clark County.

The ballots were ruled invalid Nov. 17 because absentee voters either didn't sign the return envelope or the signature on the envelope didn't match the one on file.

Voters were notified and had two weeks after Election Day to fix the problem. Most Clark County voters who received such notices responded, elections supervisor Tim Likness said, but 446 did not.

The dean of the Congressional Black Caucus is confident that at least a few U.S. senators will join House members on Jan. 6 to question the fairness of the Nov. 2 election. John Conyers Jr., the ranking Democrat on the House Judiciary Committee, told Salon.com he doesnt believe the Senate will repeat its performance of four years ago, when Black lawmakers sought in vain for one senatorial objection to official misconduct, deliberate fraud and an attempt to suppress voter turnout by unlawful means in Florida, as Congressman Alcee Hastings, D-Fla., put it at the time.

No, I think the Senate is going to go along with an inquiry this time, said Conyers. I don't think they would embarrass themselves to let this happen two times in a row I just don't think the Senate would get caught in that position. Conyers is careful not to name names, claiming he hasnt spoken directly to a single senator, but adding, There are Republicans who support what I'm doing who haven't been willing to come forward.

Conyers is the indispensable person among the righteous Grinches who are casting a shadow over the Republicans holiday. Through his hearings in the Capitol and Ohio unsanctioned and unattended by Republicans and his engagement of the Government Accountability Office to study election irregularities, the 75-year-old Detroit lawmaker has thrown an institutional spotlight on GOP crimes and misdemeanors. How high these crimes can be connected is another story, but there is no doubt that massive violations of a variety of laws occurred on the ground. Conyers prefers to call them things that went wrong in swing states like Ohio:

It depends on what part of the state we're going to examine. In Hocking County, a private company accessed an election machine and altered and tampered with it in the absence of election observers. It disturbed a deputy chair of the election in the county so much that she has given a sworn affidavit that has been turned over to the Federal Bureau of Investigation, and we're in the process of running that down.

January 5th Freedom Ride From Columbus to Washington


On January 5 at between 4:00 and 5:00 AM a very special bus trip will embark from Columbus, Ohio to Washington D.C. The organizers are calling it "Freedom Winter" in reference to the "Freedom Ride" in Mississippi which took place at the height of the Civil Rights movement 40 years ago.


Voters from Ohio who were disenfranchised on election day or ho had to make extraordinary efforts to vote or who were subjected to un-equal treatment at the polls will be traveling to the nation's capitol to participate in a press conference and to lobby select members of congress and the senate to encourage a congressional-level challenge to the 2004 electoral results.

Radio and television journalist will also be traveling on the bus along with a few of the organizers. The plan is to leave in the wee hours on the 5th to arrive in D.C. shortly after noon. The press conference will be held at the National Press Club in the afternoon and lobbying appointments are being scheduled for both before and after the media event.

Hotel rooms are being reserved for night of the 5th for all participants and there will be a rally the following day when congress officially re-convenes to certify the votes of the electoral college. The bus will return to Ohio that evening.

The cost of the bus and the hotel stay and possibly two meals for each participant will be covered by funds raised by the organizers. There may be some time on the 6th to visit some of the museums on the Capitol Mall as well.
