1) Recess appointments expire at the end of the congressional session in which they are made. So, any recess appointments that Obama would have made in 2010 would have expired January 2011 when the new session begins. 2) Recess appointments are not permanent, Congress would still have to vote on the nominee in order to make the appointment permanent.
