Why else would the Administration not involve the FISA court as the law dictates?
Only a handful of searches out of tens of thousands have ever been denied by the court.
There is NO reason to believe that bonifide investigations into possible terror plots would be denied.
The one and only reason that Bush would want to circumvent the court,is that the court would deny his request ....because the wire tapping has demonstratably NOTHING to do with fighting terrorism.
