5. In defense of the Navy
Although the board results were released after the Hamdan case, the board that made the decision actually convened and made its decision last February. The board results then had to be approved by seven or eight different admirals up the chain of command.

While conceivably any person in that chain could have knocked LCDR Swift off the list, I expect the board members would have known of the deletion and reported it to the appropriate IG.
