120. Question. What would a smart litigator do
if he or she really wanted to win an election, but on the day after the election he or she was down in the projections of the popular vote and in the projections for the electoral college?

I propose that in the PUBLIC arena, he or she would do nothing different than Kerry has far. Concede and create the appearance that he is moving on.

The new federal act and provisional ballots changed all of the time frames and all of the strategery for this election? The time hasn't come yet. A candidate is not forced to hang his or her ass out there as Gore was forced to do in 2000...before he had the opportunity to sit back and survey the battleground.

This may turn out to be a very big week indeed. Keep the faith and keep KICKIN!!
