1. Some peculiarities about that case
(read Peter Lance, 1000 Years for Revenge).

The FBI had an informant in the group that was building
the bomb. They had planned to have him substitute harmless
powder for the explosive material, and then they took him
off the case and the real bomb was constructed.

A US Army sergeant, Ali Mohamed, was photographed training
the 93 WTC bombers in the use of firearms. Later, when
he was charged in connection with the African embassy
bombings by al Qaeda, a plea bargain was negotiated by
none other than Patrick Fitzgerald. Ali Mohamed was
never sentenced in that case, and nobody knows where he
is now.

One problem with these secret detentions and such is that
they provide lots of cover for operatives--which might not
be a problem if we could trust our government.

Use of lethal injection for execution also brings up
problems in verifiability. For instance, how do we know
Timothy McVeigh is really dead?
