We know that now. And again, I think there are plenty of reasons to assert that the Administration did indeed know those criteria were not met. But I'll leave that to Fitzgerald (not to mention the multitude of other threads here on DU on that very topic) to thrash that out.

But Bush, knowing what we all know now, says he would still invade Iraq. Bush was required by the Authorization to certify that the criteria were met, and he did certify. However, since the criteria specified were not met, what Bush is doing by saying he would still invade, is demostrating his complete indifference to the Constitution*, which gives Congress the authority to declare war. Hence, my comment about the criminal tendencies. An invasion not conforming to the will of Congress, as they stated it in the Authorization, is illegal, imho.

*Of course, the other possibility is that he is demonstrating his complete lack of knowledge about how the government works, and that there really are limits to his power.
