Phelps is despicable scum. But the fact that the prevailing party is despicable scum is not generally grounds for departing from the standard rule (Fed Rule Appellate Procedure Rule 39) providing for the award of costs to the prevailing party in an appeal. The court has broad, but not unbridled, discretion, in deciding whether to depart from the standard rule. The fact that the winning side deserves to rot in hell for an eternity is, unfortunately, not the sort of grounds on which a court usually bases this sort of decision.
