By creating lots of fights, they are almost certain to win some of them. If Dems vehemently oppose several high-profile decisions at the same time, * can claim the Dems are always negative. We reach a point of "outrage fatigue," and compromise and * gets a little more of his right-wing nuttery into place.

I think it may be more likely that the Rove business will be a distraction for the SC confirmation.
